Three won't cancel contract after two days of buying it

Hi,

I Just bought a 12 Months SIM contract only 2 days ago at a Three store. I called customer services to cancel my contract and they say that I can't cancel it because the store has a No returns Policy.

I double checked the documents they gave me and I can't find any details relating to either cancellation or cooling off periods so I went online and the website states a cooling off period of 14 days. Why does it have a different cancellation policy?

Also they said the only way to cancelling my contract was by giving a 30 days notice period and to pay a penalty.

I think this is very unfair. What should I do?

    Purchasing on-line gives people the option of cancellation within 14 days - simply because they can't inspect what they're getting until it arrives. That doesn't apply to a shop, so unless they have their own voluntary cancellation you're stuck. Seems perfectly fair to me.

    Quite correct for buying instore.
    I think this is very unfair. What should I do?

    Buy online or over the phone next time you buy something that you aren't sure you actually want and might want to cancel.

    If you purchased directly from a Three Store. We’re sorry, but if you bought a Device or Accessory from a Three Store and you change your mind, you’ll be unable to return or exchange it.

    Only iDmobile, Virgin and O2 allow you to return it within 14 days.

    Can't see why I can't return something I just bought. If I go to Argos and buy something I can return it no questions ask. Why should it be different with mobile phones ?

    The problem is that the law only states that there has to be a returns period in the case of Distance Sales (online or over the phone.) Offering a returns period for a store purchase is voluntary, so you should always assume that any store purchase is final unless you have seen a policy displayed that states otherwise.

    The basis of the law is that you can return goods that you haven't had the chance to inspect before purchase as another poster said. You can't inspect a sim only contract in any case, so online purchasers having those rights in this case does seem strange, but that doesn't help you.

    Actually not, any product that you have used is excluded from the Argos return policy (which is a goodwill return and not a statutory right) so if you had bought a phone or sim from Argos and made any use of it, there would be no return allowed there either.
    We offer a 30 day returns guarantee on most items. (We’re nice like that.)

    So if you need to bring it back, just bring it back. Then we’ll either refund the cash onto the original payment method or offer you an exchange. Easy.

    You just need these 2 things:

    your proof of purchase
    the item should be unused, in its original packaging and in a re-sellable condition

    Most importantly though, the Argos return policy is a goodwill gesture and nothing to do with statutory rights of return.

    Lots of electronicy thing you cannot return toaArgos. Its all down to company policy and goodwill.

    Being able to return goods purchased in a store is an assumed right, it is not legally the case unless the goods are faulty. Many stores are happy to refund or exchange goods, however in the case of signing a contract in store it's a completely different matter.
  • To answering some members, I actually want to return the sim card as I bought two, one was for secondary use and the other one as a backup. The one I want to return hasn't been opened nor activated.

    Unfortunately (as has been said) you can't, the terms under which you bought it don't allow return/cancellation and you have no statutory rights that would allow it.

    It's only possible to return in store purchases if the store will agree to do so as a goodwill gesture.
