  • I have just received another letter from ZZPS urging me to pay and referencing other cases that they have won, say its in my interest to pay, the next step they say is getting solicitors involved namely Wright Hassle.

They've never 'won' any parking case, as they have no case to progress. They are just irritants in the process.

Your proposed next course of (in)action is the correct one!

  • I have now had a letter from Wright Hassall saying they have been instructed by ZZPS in connection with the recovery of a debt, and failure to make payment or contact them may result in them recommending to their client that they may pass this matter to their litigation dept, this may mean they will look to obtain a CCJ, and then it lists impacts of me having a CCJ against me.

    Again I assume I ignore.?

    Signed by Tim Hawker!

ZZPS cannot sue. It's likely a letterhead pimped out by WH for ZZPS to send out at a couple of quid a shot. I bet it's headed 'Letter of Claim' not 'Letter Before Claim'. Different beasts.

I don't think we've seen any parking company represented by WH in pursuing litigation in terms of issuing court claims, nor indeed representation at court.

They're dabbling on the periphery, probably realising that getting involved any deeper is likely to see them getting their fingers burnt.

You could send a robust reply to Hawker, same as poster 'robinbetts' is doing.

  • Yes Tim Hawker has signed, thanks for the link to the letter, I will use that as a basis for an email / letter. Thanks again for all your help.
  • After sending an email of complaint to Wright Hassle using the letter mentioned as a template, I have now received a letter from them....Acknowledge of your complaint. My comments have been passed to there customer assurance team for a response, while they are investigating my points my file will remain on record.
  • Is there a period of time NCP have to settle the claim, I thought I read somewhere if it wasn't settled after 6 months there initial 'fine' becomes invalid??

You're getting completely mixed up with that.

Who is claiming from NCP? They are claiming from you, surely?

I think you're confusing the time limit the Train Operating Company has to take you to the Magistrates Court for prosecution under the byelaws - after 6 months they can't prosecute.

NCP, if they are pursuing under contract law have 6 years to issue a small claim in the small claims court - which is much different to the Mags Court. After that they can't litigate, but they could, in theory, chase an alleged debt for ever. But they won't.

  • I have just received a reply from Wright Hassle after the email as stated above i sent. They have rejected both claims that i was not provided with a clear explanation of how the amount has been calculated also not listing the essential documents on which you intend to rely and not offering any form of ADR to avoid unnecessary court action. conclusion contact them within 7 days to pay the bill of £196. Do i just still ignore??

Only respond if you get a formal (headed) Letter Before Action or real court papers. Come back if you get either.

To my knowledge, WH has never fronted a court claim on behalf of any PPC.
