Car accident

Hi all,

I was pulling out of my drive by reversing and had almost 30% of my car on the road before someone deciding they don't want to stop and bang hit the car.

I have reported it to insurance, is that my fault or theirs?

  • Yours. No matter how fast you were going, how much you could or couldn't see and even if it was due to the other driver not paying attention enough to stop, what it would come down to is you reversing onto a main road into traffic.

    It is not illegal to reverse into a main road but it is not advisable - this is for safety reasons. The main road is likely to be very busy and there will be an increased chance of an accident due to the presence of more cars on the road. If an accident occurred due to you reversing onto a main road from a minor road then there may be the possibility of you being prosecuted for driving without due care and attention.

  • Well it is an alley with 20mph limit and not main road.

    I was almost 30% on the road when i just saw here and she was speeding and didn't bother slowing down

    It is all on camera which shows how far back i was on main road and how she didn't even attemp to slow down
  • As you were the one "entering the carriageway" the onus is on you to be absolutely sure it's clear and that there is a safe gap/opportunity to do so. I believe 100% blame will be attributed to you and not to the other driver.

    If they were telling their side of the story it would be that you suddenly exited your driveway and appeared in the carriageway, giving them nowhere to go and causing the accident.

    I don't think you can prove that they were speeding, but that really isn't likely to be a consideration in this case.
  • Agreed but it is a not a carriage way but a alley

    You can see from camera footage that i was on the road and she could have clearly see me when sh put her foot down

    The alley is not that long so she must have driven off when i was pulling out and bang

    With the best chances, your insurance might argue 50/50 if you're lucky.

    We haven't seen the camera footage so can't really comment fairly.
  • Last idiot to reverse into paid up. My insurance company made sure so, and I did not need a camera.
  • So you mean you reversed out of drive and they claimed the driver on main road was at fault?

    What is the process with this things?

    If I am not happy with my insurance decision what can i do?
