Redx so basically you advise to wait it out.

Thank to all of you guys

I advise you to learn all the facts and make a decision as to either

    paying (which we dont recommend)

appealing to the IAS (which we dont recommend)

doing nothing for 6 years unless the PPC issues an LBC in the post (probably via Gladstones) , or you get an MCOL from Northampton in the post - neither should be ignored , so you deal with those two (which is what most of us here recommend)

by doing the latter you are running the risk of a possible court case, in small claims court , by MCOL

we dont tell you what to do, we advise you of the scenarios and you make your own decision , based on the facts
  • Yes I understand it's my risk.

    after doing:

    PCC - done and failed
    IAS - no

So after all above there is basically only waiting left for 6 years and during that time when I get LBC letter I will need to reply to it.

Is getting an LBC letter a inevitable outcome on every such occasion?

An LBC is not inevitable. There are hundreds of thousands of motorists in your position, not all can possibly be issued with LBCs, there's not enough trees in Brazil for that.

But Millennium have become court-frisky, so prepare for the issue of a LBC and you won't be caught napping. If you don't get one, then it's a bonus.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

GLADSTONES get paid by recommending their members to try court , so its certainly possible that GLADSTONES will persuade the PPC to issue an LBC and then an MCOL , they do this on a daily basis at the moment with verious members and its well documented on here , on pepipoo forums and on the parking pranksters website too (as in , "YOU`VE BEEN GLADSTONED")

So now I'm wondering if this is the end and the only thing left to do is to pay? really?
No. Where does the NEWBIES thread ever say that then?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Guys I’ve just realized that I didn’t actually appeal to MSE or IPC yet and instead I’ve only used their (IPC’s) complaint system which is like web contact form where I asked them about my case and they straight away referred me to IAS and this was the end.

After reading Newbie post I made the following steps list, would you please check them out for me that it’s all good
    1. FIRST STEP.
I’ll send a recorded delivery letter to MSE (PPC), on the 26th day after receiving my window parking ticket (accordingly with Newbie guide). Since they only accept appeals by letter, how do I give them my contact details without divulging my identity “registered keeper, and give them my email address to reply me”? Or it is ok to leave my identity?

    2. QUESTION: Should I appeal to IPC before the second step? Or do I appeal to both of them at the same time?

    3. SECOND STEP.
I am a bit confused about if I could actually appeal to Popla or not. MSE promotes IAS on their website and the ticket itself. They are members of BPA:30602

Newbie guide tells me: “You can't appeal to PoPLA unless the PPC is a member of the BPA.”

      BUT

Popla Faq tells me “…If you have received a ticket from a parking operator who is a member of the Independent Parking Committee AOS, please visit their website…” and the link at the end goes to bloody IAS! which as suggested I’m going to skip.

QUESTION: So can I or I can’t use Popla? Is there any choice for me there?

    4. THIRD. If I loose my case, come threats and all this fun stuff and eventually they may sue me.
  • do not send it recorded , send ot first class with proof of posting

millenium use the IPC as a trade organisation , therfore you cannot use POPLa , you can pnly use the IAS (or not)

    1) NO , send it FIRST CLASS with a FREE CERTIFICATE OF POSTING from the P O COUNTER (not recorded)

    2) the IPC do not accept appeals

    3) there is no POPLA for IPC members, only the useless IAS (DONT BOTHER)

    4) YES , THREATS and a possible COURT CASE in the SMALL CLAIMS COURT (MCOL)

the latter is similar to the judge rinder tv programme , although it may be in a small room and no audience, plus not shouty theatrics or tantrums

the legal aspects are the same , so ignore the silliness and concentrate on the legal saide of that programme and you will see what sort of thing it entails , a claimant (or a legal representative or a company representative) on the one side and the defendant (you) on the other , possibly with a "friend"

that is assuming they pay a court fee and try it , they have 6 years to try it

Just repeating what I thought was clear in the NEWBIES thread:

    Don't do IAS.

    Don't contact the IPC.

You can't have POPLA because this is not a BPA member.

Come back if you get a small claim to defend. You could read other threads about Millennium in the meantime, we have quite a few. Easy to find using the one keyword search 'Millennium' but NOT searching the whole of MSE as so many newbies do. Search just THIS forum board.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thank you so much to all of you guys, again.

PS. how much is the small case court fee anyway?
