Was told to appeal with IAS, is this it? did I loose already?

Hi,

Millennium Parking Services left me a ticket for "parking out of bay" at one of my building's designated spaces. I have my parking permission displayed in the front window at all times.

There are some gutter works going on at the moment and I had to leave the workers room and other spaces where full at the time of parking so I had to park over the painted line and that got me a ticket.

Before finding these forums I've already made a "complaint" on theipc.info website, address was on the ticket. NEWBIES FAQ considers this is the first step which has already failed. They simply replied to me to appeal on theIAS.org but again NEWBIES FAQ says that appealing to IAS is basically pointless.

So now I'm wondering if this is the end and the only thing left to do is to pay? really?

EDIT
I have to add that there are only 3 cars with permission to park on 8 available spaces, so if no unauthorized cars are parking there is plenty of room to park even sideways if we want to, but because of these work being done there was a little tight.

    no , you dont have to pay unless a judge says so, in court

    the IAS is a kangaroo court , so you will most likely fail there

    but the decision is not binding on you (neither appeal is)

    its court where thedecision may be binding , if you lose and cannot appeal it

    So what would be the next step then, should I appeal @IAS?

    that question has been pondered many times on here , some say YES , the majority say no , I say NO , like coupon-mad says NO

    its an 80% failure rate , or more , for the IAS appeals

    the decision is yours to make , not ours

    if you dont appeal , you do not have to pay

    if it goes to court and you lose and a judge says PAY , then pay , promptly

    1) don't bother with IAS
    2) ignore debt collector letters that will inevitable follow for up to 6 years
    3) do not ignore an LBC
    4) READ THE NEWBIES THREAD!!

    I appreciate this may be new to you, but the same questions get asked 10 times a day by other new posters who all think their case is a bit special and not like all the others. 99 times out of 100 that's NOT the case, and the NEWBIES thread has been painstakingly put together the deal with the basics. Please use it!

    What won't help you is a (almost inevitable) loss at the IAS. The PPC will be buoyed by their win, and will use your loss via the 'independent' appeal procedure to bolster their claim against you at the county court.

    Millennium are becoming very trigger-happy in serving court papers, so you don't want to give them any more ammunition that might harm your cause. It's now only likely that you can get rid of this charge via defending at the small claims (county) court. This doesn't mean we are recommending you pay this, far from it. From your description in your first post you have no reason to pay anything.

    My advice is to see what happens from here on in, but don't go ostrich on it, use the time wisely to read up on other Millennium cases on this forum and on PePiPoo, reading how others have progressed through the process and how they've constructed their defences. This will not go away of its own volition. Be prepared well in advance.

    you were invoiced for money by the PPC for "allegedly breaking their rules"

    you disgree with the PPC

    so you appealed to the PPC

    it was rejected (which is always the case)

    you do not wish to appeal to the IAS so you dont

    you are at an impasse with the ppc
    they demand money , you reject their claims

    you also IGNORE (and reject) and DCA letters too

    the PPC has 6 years to try a court case (like in Judge Rinder) - MCOL

    if it gets to court , a judge decides the outcome

    none of this "helps you"

    it is an explanation in simple terms of where you are "up to"

    if the PPC were to win at the IAS, it could harm any future court case , hence why we say "dont bother with the IAS"

    if you win in court , you pay nothing and claim costs of up to about £90

    Actually. it is not a bit like shouty drama queen Judge Rynder. No flags, no gowns, no lecterns, no usher, no spectators, no canned laughter. You all sit round a table and present your case. At the end the judge comes to a decision.
    You never know how far you can go until you go too far.

    As was my advice, BUT get on with learning what this is all about NOW.
