    Apologies, i am still waiting on the lease to be sent to me to look through, this is a transcript of a 'CAR PARK ENFORCEMENT NOTICE' put up in the accomodation.

    This car park is for PERMIT HOLDERS ONLY. You must ensure your permit is CLEARLY VISIBLE (ie) front window screen or dash board after you have secured the vehicle.

    Please make sure you have parked in your designated space ONLY.

    Any vehicle parked in the wrong space or not clearly displayed a valid permit will be issued with a parking notice.

    If you have been issues a notice and you want to make an appeal you must write to CMS LTD on the address on the reverse side of the ticket. If you feel dissatisfied with how your appeal has been processed you will need to contact The British Parking Association.

    If you have any queries in relation to the parking services please contact CMS direct on 01253 725944.

    I imagine this notice is not binding as no signature has been signed for this notice and also they refer to the BPA rather than IPC. As soon as i get the rental agreement i will forward on what it says about parking.
    With the letter i send to them do i identify the registered keeper by name and put address as well? I imagine it doesn't matter too much as they have already gotten these details from DVLA and will flag up once entering the PCN number.

    Even more obviously, it doesn't state £100. So no-one has agreed to pay £100 under some pseudo contract.

    Hello again guys,

    The driver sent the letter based on the template from the newbies page as you suggested but did not hear a response to that. From there they have passed it onto ZZPS and from there now onto Wright Hassall solicitors who are now claiming,

    "if the debt is not repaid within 14 days we anticipate being instructed to commence County Court proceedings against you without further notice"

    This is now at £208 and the end of the 14 days will be May 2nd!

    I have gained the tenancy agreement and this has no mention in it about parking at all apart from parking a caravan!

    What would you guys suggest my next step be?
    - Contact the solicitors, explain the driver had the permit in the car but must have fallen down and that it also mentions nothing about parking in the tenancy agreement which was signed? (they didn't respond to my request within the template letter sent for the images they had taken of the vehicle)
    - Contact the original PCN company CMS?
    - Contact the intermediary (imagine debt collector) company ZZPS?

    Any help and advice will be greatly appreciated guys!

    Little or nothing you can do at this stage (but that definitely does not mean pay them, anything but). Contacting a debt collector is ill-advised (see NEWBIES FAQ sticky, post #4 re debt collectors).

    If the Wright Hassall letters say to pay ZZPS, then this is nothing more than a pimped out letterhead for ZZPS to unnerve you - ignore it.

    Only now respond to a LBC or MCOL claim - come back if you get either.

  • The letter from Wright Hassall solicitors states,

    "This letter is a Letter Before Claim pursuant to the Practice Direction on Pre Action Conduct and Protocols"

    Who they are suggesting payment goes to is unclear as they just offer a number to call to discuss repayment (there is a 'support' email address on the letter as well).

    With regards to ZZPS it just says that "we are instructed by ZZPS limited on behalf of the Car Park Operator.

    How do i respond to this in haste of the 14 day deadline being May 2nd?

    Do a forum search here and PePiPoo, on 'Wright Hassall ZZPS' and read other threads, where you will see how others have dealt with this using a robust response. The reality is ZZPS cannot instruct WH as they don't 'own' any alleged debt.

    If the letter is signed by Tim Hawker then it's a debt collection letter. Search the forum for the obvious unusual keyword 'Hawker'.

  • I am trying to upload images of the letter i have received but it wont allow me to as i am a new user, how do i get around this?

    Am i to respond to this by the date (tomorrow) as if this is a 'Letter before claim' that is true. But if it is as you have suggested just a debt collection letter i have time to respond/wait for their response.

    Your help is greatly appreciated!

    Upload your images to something like Dropbox or Tinypic, copy the web links and paste them into your post here, but space them out around the "."s and change http to hxxp - these'll break the links, but a regular can repost them changed to live ones for you.

    Does that mean that i need to respond by tomorrow? and do you have any advice on what to write, i have some ideas from the other forums, they suggest pointing out issues in the LBC, anything which jumps out at you guys with more knowledge than me?
