***Urgent*** IPC parking charge notice help - CM Services****

Hello all,

I got a PCN mid December but had assumed it was 'fake news' (as Trump would say) and ignored it. I recently got a 'Notice to keeper' letter through claiming the fee has increased to £124 from the initial £59.

The driver had parked at a friends accommodation but had not put the permit up in the car properly, but upon reading through the newbies page it seems the IPC/IAS are scumbags and in it together. I was wondering what anyone would suggest to do from here?

Use the letter template in the newbies bit (even though its suggested to be used around day 26?

The driver has until the 20th February according to the letter so i would appreciate your urgency and any help/advice!

    Send the IPC template letter you will find in the NEWBIES. That's what it is there for.

    What does your friend's lease/AST say about parking/parking permits as this will supercede anything a third party says. If the lease/AST does not mention permits, or the driver parked in accordance with the terms of your friend's lease/AST then there is no need to display a permit and the driver has done nothing wrong.
    The relevant part of the lease/AST should be quoted in addition to the template I have already mentioned, but do not reveal who was driving.

  • The lease says to just go through the parking company CMS directly to dispute. Also says the permit must be displayed clearly etc. My friend also rang up the company which owns the block of flats and they again want nothing to do with it!

    Cheers for the help, i will send the letter to them and see what response it is and let you guys know!

    they will reject it as there is no profit in acceptance

    BUT SEND IT ANYWAY , with FREE proof of posting if using the P O from the P O COUNTER (NOT RECORDED)

    then you have up to 6 years of harassment and debt collector letters , which can be ignored

    come back if you get an LBC or an MCOL in the post , within the next 6 years , these 2 should NOT be ignored

    Right so the lease (leasehold ownership) says that, or the AST (tenancy) says that? Sounds very un-legally worded for a lease.

    So, it does not create an obligation to pay £100? Or even warn of £100?

    That doesn't sound like the lease to me, more like something on a bit of paper associated with the parking company.
    Check again.
    From the Plain Language Commission:

  • Apologies, i am still waiting on the lease to be sent to me to look through, this is a transcript of a 'CAR PARK ENFORCEMENT NOTICE' put up in the accomodation.

    This car park is for PERMIT HOLDERS ONLY. You must ensure your permit is CLEARLY VISIBLE (ie) front window screen or dash board after you have secured the vehicle.

    Please make sure you have parked in your designated space ONLY.

    Any vehicle parked in the wrong space or not clearly displayed a valid permit will be issued with a parking notice.

    If you have been issues a notice and you want to make an appeal you must write to CMS LTD on the address on the reverse side of the ticket. If you feel dissatisfied with how your appeal has been processed you will need to contact The British Parking Association.

    If you have any queries in relation to the parking services please contact CMS direct on 01253 725944.

    I imagine this notice is not binding as no signature has been signed for this notice and also they refer to the BPA rather than IPC. As soon as i get the rental agreement i will forward on what it says about parking.
    With the letter i send to them do i identify the registered keeper by name and put address as well? I imagine it doesn't matter too much as they have already gotten these details from DVLA and will flag up once entering the PCN number.

    does that over ride your lease? , has that statement been added to the new copy of the lease that you signed for and recieved?

    its about as legal as do not park pink cars on the grass
  • I do not think that has been attached to the lease my friend has signed. He is currently at work but hopefully can send the whole lease through for me to pass on the relevant section to you guys!

    The lease is all important, it trumps any rubbish dreamt up by a PPC.

    BTW, there is nothing "urgent", (or remarkable), about this, just some tin-pot company trying to scam you. Look them up on the Companies House website.
    You never know how far you can go until you go too far.

    But, TD, the OP has put 10 asterisks in the thread title - it must be very URGENT.

    It would be even more URGENT if there had been 10 exclamation marks.
