Parking Charge Notice TSP Car Park Managment Ltd

  • Hi guys

Hope somebody can help me out, I find myself in a very similar predicament. I am more than sure i have ground for appeal but just wanted to see what everyone elses point of view was:

    - I have bought a flat, which comes with a parking bay. I also pay a service charge for the car park and landscaped areas etc.

TSP parking have been assigned to enforce parking with all residents being sent a blue sticker (via post). Mine hasnt arrived yet and since coming into force i have now been issued with several of these "invoices" dressed up as fines. I wrote to TSP to set out my legal position and prohibit them from utilising my space as a business, also challenging the legality of their practices. I then phoned them to let them know somebody else had parked in my space and whilst on the phone, i asked for clarity on how these guys substantiate their £100 invoices: to which they replied "well, we have vans to pay for, corporation tax, men who walk the car parks, so we are well within our rights to charge £100.00" Trying hard not to laugh, i then asked why i had been given the tickets as i was parked in my own bay and was simply told to wait and see what happens in court.... they relied on the Beavis vs parking eye case too.

I have spoken to residents and it appears as though nobody has agreed to TSP being instructed to enforce parking restrictions (bearing in mind our car park is never ever full) and i would now like to call a vote to get them removed.

    My question is two fold:

    A) Am i right in assuming that TSP invoices are un-enforceable and their practice is flawed
    B) What are my rights with regards to getting them removed from the management team

    Would really appreciate feedback
