£60 for a drop off in front of a SPA - PCM

Yes, that's the location, the contract allows drop off but they say in a designated bay which is not marked with any sign at the entrance of the site and it's on the opposite side of the spa/hotel
The actual contract is shown here as one of the links at the bottom (but read it ALL):
https://bmpa.zendesk.com/hc/en-us/articles/214269665-Hayes-and-Harlington-Station-Roboclaim
Nothing in the contract about dropping off in a bay. You are allowed 10 minutes to drop off 'around station area'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As this charge was incurred in the course of your employment, you should treat this as a business expense, (tax deductible) and, once it has been thrown out at appeal, invoice the PPC for your time at the court approved LIP rate of £19 an hour.
Do you have a union? If so, perhaps their legal officer can help. It might also be worth your time complaining in writing to your local Trading Standards Officer and your MP.
The more fuss you make, the more in will cost them. You never know how far you can go until you go too far.0 -
I saw your link and other documents attached in that link..thank you..I think I will write them again to cancel the charge if not I will wait for the letter to go in court if they want to and they are going to lose because
1. I stopped for 1 minute for drop off passengers
2. Their signage with drop off bay is too high and you can't spot them from the car
3. They didn't allowed me time to read the "contract"(signs) and decide if I want to stay or leave
Anyway they are going to lose too much money with me in court instead of canceling the charge.
Thank you guys !0 -
Anyway they are going to lose too much money with me in court instead of canceling the charge.
That does not seem to worry many of them, they push ahead, lose, and get a rollocking from the judge, who then awards the poor put upon parker peanuts.

Who took on the parking company?
if there are any expenses, or even a DPA breach you should be invoicing / chasing up whoever took on the PPC
who has overall responsibility for the site, including the hiring of the parking company? From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
The Government issued very helpful guidelines on POFA https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/9155/guidance-unpaid-parking-charges.pdf
The last paragraph in point 1 on page 26 seems to be applicable in your case, but others more legally competent may offer a view that is different.
Incidentally, looking at page 26, it seems to me that this government document made it absolutely clear about what level charges should be and it would appear that the Supreme Court, supposedly tasked with implementing what Parliement's intentions were, erred in their Beavis judgement. Was this government produced guideline paper ever introduced into evidence?0 -
From what I understand I didn't made them any loss so they issued a charge for nothing, another reason why they are bullies and they will lose if is going to be a court case ..0
-
Indeed you didn't cause them loss - but please don't use the argument about 'no loss' in any appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guys, i have exactly the same situation here, in the same location. I received a letter from PCM which shows my car stopped outside the marked areas. The pictures have been taken by phone. I checked all of them and i was there for about 40 seconds! I am a cab driver and i was setting up the sat nav and i drove off within 40-45 seconds. The problem is that the car is a rent car and the letter went to the company office and they pass it on to me. What should i do? Should i just tell the company to use my details and then i challenge them?0
