Notification of Intent to prosecute (speeding)
I Just received an Intention to prosecute letter from the police for speeding. I was doing (51MPH on 40MPH Road).
I already have 3points on my license just almost 2 years for using my phone whilst driving. I had the opportunity to visit the awareness class which I didn't so I had to pay a fine and then collected the sad points.
Now I don't know what will happen to me. Do you think I will get the speeding awareness class and not get more points or am I facing another sad Points on me license?
I really don't want anymore points!!!!

It's unlikely you'll be offered a course ; take a look here :
http://www.cps.gov.uk/legal/p_to_r/road_traffic_offences_guidance_on_fixed_penalty_notices/
The guidlines are, for a 40MPH limit, a course is offered for speeds up to 46 MPH. Yes, they are guidelines, rather than hard and fast rules. But 51 in a 40 zone is quite excessive.
And I hate to sound "holier-than-thou" ... but 51 in a 40 is not really "being careful".0 -
46 in a 40mph limit is the normal threshold to start proceedings (of any sort), i.e. 10% +2mph.
The guidelines for the offering of a Speed Awareness Course are where you exceed the limit by up to 10% +9mph, so in a 40mph zone you should get such an offer up to 53mph.0 -

That link doesn't seem to work, but even if it did it would be irrelevant: the CPS have nothing to do with the offer of a course.
The current police guidelines (in England and Wales) allow a course up to 110% of the limit plus 9 mph, i.e. 53 in a 40.0 -

I Just received an Intention to prosecute letter from the police for speeding. I was doing (51MPH on 40MPH Road). Honestly I was unaware of my speed and the same road I was on was a 70MPH before the 40MPH speed camera flashed me
How long before someone highlights that?
Edit: Oh, someone just did while I was typing.0 -
Just send the form back within the 28 days, and hopefully you will get a course.
I sympathise though, round here the limits go up & down like yo-yos, and seem to be lower each time you drive on a road.
It is almost as if they are trying to catch you unawares, as if you know the limit has been 50 for the past 30 years, you don't see the signs.
Funny how they can have "New Road Layout" signs up for years, but "New Speed Limit" might only last a couple of weeks..........I want to go back to The Olden Days, when every single thing that I can think of was better.....

The minimum time between courses is 3 years. Not sure if that applies also to courses offered in the last 3 years or not. If it does and you declined 2 years ago, then you'd not be eligible.
Your 'defence' is not the best I've ever seen. What relevance has the prior speed limit being 70mph got to do with it if you were speeding in a 40mph limit? There's no 'buffer zone' beyond the 40mph limit sign that allows you slow down when you think it appropriate. No free lunch, and no free laptop0 -

He is eligible even if he did the course, that was for a phone this ones for speed. You can do each one of the three courses offered but not the same one within three years.0
