make sure you get it in writing, if you havent put your SMART appeal in yet , do so, but add a line that the landholder has cancelled the pcn

if you have put the appeal in , make sure you get an answer , in writing , dont let it lie and then be in a worse position in a month or three`s time

too many people assume that the cogs are all in sync , they arent

and well done for stticking with it and complaining properly , and vehemently

and bear in mind this happens on retail parks, hospitals, supermarkets , doctors surgeries and many other venues, so be careful in future , because it will happen again, and again

Potentially great news that the hotel will cancel.

Once cancellation is confirmed, post a review on Trip Advisor telling potential customers of the plight you suffered, which took a complaint to the Ops Manager after other staff washed their hands of it, and suggest they think very carefully about staying at this hotel, where clearly, with some staff, customers feature far lower in their estimation than the operators they employ to hassle them.

    'THE CUSTOMER'

    1. The customer is not dependent upon us—we are dependent upon him.

    2. The customer is not an interruption of our work—he is the purpose of it.

    3. The customer is not a rank outsider to our business—he is a part of it.

    4. The customer is not a statistic—he is a flesh-and-blood human being completely equipped with biases, prejudices, emotions, pulse and blood chemistry.

    5. The customer is not someone to argue with or match wits against—he is a person who brings us his wants, through which he brings us our wealth. If we have sufficient imagination we will endeavour to handle them profitably for him and to ourselves.

I just want to thank everyone for their help. After contact the park regis again, it looks like it's all been cancelled now! I haven't heard back from smart parking, but I was certainly feeling hopeful. Thanks everyone, will make sure to come straight back here if this happens again.

I have a similar situation although the car was registered by the driver at the hotel reception. Can I ask who you contacted to get the charge cancelled?

The OP hasn't logged in to MSE forums since August.

You may not get a timely response.

Thanks, can you tell I’m an amateur?! I think I’m going to have to go against everything I stand for and pay the fine - i don’t think I can wait 6 years to find out whether they’re going to try and take my to court

Whaaaat? Pay Smart Parking for fear of a court case? No, don’t do it.

In the past couple of years Smart have issued over 800,000 (eight hundred thousand) tickets. Until this year, they had never ever tried a court case. This year they dipped their toe in the water, but when a defence statement was produced they immediately discontinued. I suspect the 10 showing in the following link are those cases where the motorist never defended and are therefore likely default judgment cases.

So at worst you might consider you have a 1 in 80,000 chance of having court papers served.

Did you know that there is a 1 in 200 chance of dying in a road accident. Are you driving to work today?

    Are you serious?

You say you actually complied with their silly rules but they seem to have messed up, why wouldn't you get stuck into them and make them sort it out.
The OP probably contacted the general manager can't you even try that yourself?
A good appeal to POPLA is likely to win if that fails.
Have you read the newbies thread?
Have you even read this thread fully?
If so you would also know this is not a fine!
Smart have issued 197341 charges this year to date and been to court 10 times do you really think they will be interested small fry like you?

If you know that it was registered in the hotel, then
write to the CEO and request confirmation of this.
The hotel is jointly responsible for their agents
    Ask to CEO to cancel

Don't pay a scammer, get this nipped in the bud now

If this hotel does not cancel pdq, write some very uncomplimentary stuff on TripAdvisor. I would never stay at a hotel that allows a PPC to harass guests.

Haha okay, point made :) I will continue to fight my corner. General Manager was emailed last week but no response (despite requesting acknowledgement of my email within 72 hours), CEO has been emailed today. Let's see what happens...
