Would the template I've used above be the one I should use? Some bits don't entirely apply to me is all. I don't want to submit an appeal and then them decline it so of course want to get it right the first time round.
Would I be correct in thinking they have no power or anything to get the police involved?0 -
Personally, I would not say that over two hours is a reasonable "drop off" time.
However, because these companies are so greedy and without a shred of reasonableness, I hope that you fight it, win, and cost them money.
Personally, I would not contact the hotel as, apart from hiring this scum, they are, more or less, blameless.You never know how far you can go until you go too far.0 -

add an extra line saying
"THE DRIVER HAD PERMISSION TO PARK BY THE LANDHOLDER AS THEY WERE A PAYING GUEST SO THIS INVOICE SHOULD BE CANCELLED FORTHWITH"
do not mention who was driving at all

its getting a CCJ due to contempt of court (not paying the judgment if you lost) that causes all the issues
this wont happen as you have the initial appeal, the popla appeal and court , before that happens
then , if you did not pay the court (the claimant) - only then does the trouble start with credit scores (you are worrying about the end of the world 5 billion years too early) - its a CIVIL MATTER , not a criminal matter, so nothing to do with the police or the magistrates (this isnt OPERATION YEW TREE , its an unpaid speculative invoice)
in your job I am sure you know what an invoice is, in this case its an unwarranted speculative invoice issued to somebody doing nothing untoward
concentrate on the here and now, SMART will fold or lose , plus up to now they dont try court anyway (MCOL)
COMPLAIN IN WRITING to the CEO of the hotel at head office , DEMAND a cancellation , IN WRITING (as an aggrieved customer)
10 minutes (or two lots of 10 minutes either side of a parking period) are the usual "GRACE PERIODS" or in your case the "reasonable time" period , so maybe 20 minutes tops , not 2 or more hours , so dont go in with that idea at all or you will fail
anyone ignoring a pcn in this day and age is a fool , ALWAYS APPEAL (assuming you dont cave in and pay the sc@mmers)0 -
I tend to agree with TD and there are grace periods allowed for in parking , but the OP really has pushed the boundaries here, 2hrs and 16 minutes is parked in anyone's book surely.
Though no reason to pay a ppc scammer, after years lurking on here I read all parking signs more carefully.
But I doubt the hotel will be very sympathetic, its just episodes like this that ppc's use to sell in their scam services.0 -
Thanks everyone so much for their reply. Once filling out the online form it asks for any evidence. Do I need to supply any picture or anything (I don't have any) or is the paragraph sufficient enough as evidence?0

just use the template (like I said earlier , with the line I gave you added to it) - nothing more is required - tell them nothing , give them no "evidence" , plead the 5th !!
meanwhile , get the hotel on your side too, if they own the land0 -

I know it's not a lot of money, but the whole principle is just really annoying. Like I say, If I had left the car there overnight and I wasn't a paying customer then I could understand. Thanks for your help so far,
With regards to contacting the hotel. As soon as I received the letter yesterday I phoned them up and he proceeded to tell me that this is out of their hands and is now in the hands of Smart Parking. I kept telling them that, THEY are the land owners. I don't think he really understood what was happening and just proceeded to tell me that the car park was signposted. I've now found the operation managers email address and sent him an email explaining the situation so I can maybe start logging things in writing. So far I haven't heard anything back from them, fingers crossed that they'll reply soon.
EDIT: I'm pretty confident that The Park Regis are the ones that own the land however could be wrong. On the letter it simply states the land owner, nothing else0 -

Well it won't be the poc that owns it that's for sure.
What you need to grasp is that this is all about money, the ppc's often write into the contract that a cancellation by the land owner will cost them around £20, also very often that same landowner gets a £10-£20 bung for every successful victim that pays up. Hence why they say it's out if their hands.0 -
there is no paper trail in phone calls , which is why Judge Rinder expects EVIDENCE on BITS OF PAPER , in WRITING (or emails , or texts , or faceache messages , or whatsapp or snapchat messages)

I have never heard of phone calls fixing anything , plus in my dealings WRITING always gets results , phone calls get you "fobbed off" PDQ
write to their CEO, like Dom Littlewood would do , that should yield results0 -
I just want to thank everyone for their help. After contact the park regis again, it looks like it's all been cancelled now! I haven't heard back from smart parking, but I was certainly feeling hopeful. Thanks everyone, will make sure to come straight back here if this happens again.0
