  • I have every sympathy for and empathise with you and your health and the difficulties you are having with the PIP application and assessors but I have difficulties with some of what you have written.

Heavy duty drugs can successfully relieve at least some pain but they often come with sometimes very significant side effects.

In my view, you are being judgemental on limited evidence on those families in social housing who go to ASDA by taxi. How do you know someone in a taxi lives in social housing? Neither do you know their circumstances. A supermarket shop for a family is likely to be large and difficult to carry so a taxi may be a sensible option. Not necessarily the best option - ordering online and getting it delivered would be better (and cheaper than a taxi). If they could order online and get it delivered then you might be justified in judging them stupid for not doing so but not necessarily dishonest as rumour mongers imply. (also this thread is about the disabled applying for PIP in particular not families on benefits in general). i repeat I see no evidence of taxis being used excessively (or much at all) by social housing families on benefits in my area).

So you appear to be questioning the honesty of some social housing tenants on limited evidence and criticising Gordon Brown and David Cameron for claiming DLA because they felt entitled rather than needing the money.

This may seem harsh but as you have have said in a previous post that you use (and feel entitled to use) your DLA to benefit not yourself but your grandchildren are you not being a touch hypocritical? Will you disclose to the DWP PIP decision maker/appeal adjudicators that you use your DLA for the benefit of your grandchildren or really put your money where your mouth is and withdraw the PIP application?
I stand by what I have said.
Let's put it another way. Why is it that (and is apparent to others who have mentioned this to me) during the day on the private housing side of the estate you will see very few if any men under the age of 65'ish? Why do you not see taxis running up and down the road day and night? Why is it that during the day you will only see mum's with children and the retired men walking to the school to collect little ones?
If the truth be told after say 9am until 6pm our area is akin to a ghost town with very little movement of people (other than mentioned above).
On the housing association side, it is the exact opposite - why?

I don't have the capital wealth that Brown and Cameron have. We live a very quiet low cost life. I claim DLA at the moment and have sent off the PIP application because it is the sensible thing to do. For DLA I fit the requirements and receive an award. I honestly can't say that for PIP as after looking at the descriptors I calculate that I will not get any award. That I will accept. However for the time being and not having any real ' extra costs because of my disabilities' I give it to my children and grandchildren as they do need it.
If however I had an income or capital of such a level that we and all of my family were financially sound, I would not be making such a claim - there would be no need to.
This is much the same as the government setting figures for those who are over 65 and disabled as to how much income that they require to live on. If your actual income is lower then the government would top it up. What happens if those individuals don't need the level that the government say they need? Would it be right to spend it for the sake of spending it or put it to good use by handing it to others?
  • So you don't need PIP Rockingbilly, yet you want to claim it just for your grandchildren.

    That is fraud.

It is not down to financial need - but physical need that many of us are claiming DLA\PIP under !!
  • He says himself though that he doesn't need it - he gives the money to his grandchildren.

    rubbish
I don't receive PIP. I have only just sent off the claim form.
It's not fraud in any event if you are entitled to it. It's up to me what I want to do with it.

Thank you, I would imagine that there are thousands who receive DLA or PIP that don't need the money. For the time being neither DLA or PIP is means tested.

    O P

I hope that you manage to get your correct PIP. You sound like someone who is trying hard to work and should be applauded for that.

It's fraud Rockingbilly if you don't need it. You admit yourself you won't use the money for your benefit. That is what gives detractors the excuse to cut benefits.

Why should your grandchilldren benefit from something that should be helping you?

It would be like me giving my sister my Motability car and me not getting the benefit of it. That would be fraudulent.

    ....

I would not put it quite as strongly as fraud - more hypocrisy given that he does not need the money and has complained that others have claimed when not needing the money..

I suspect Fbaby would think that he should disclose on the application form for PIP that he gives his DLA money to his children for the benefit of his grandchildren.
Do not be fooled into believing that this society cannot be made fairer because hard work isn't necessarily all it takes.

if you are working and you qualify for PIP you may be entitled to enhanced payments from HMRC

Whilst DWP don't ask on the form regarding employment, they will know everything is done in Real Time reporting now and therefore armed with your NI number they will know.

They may not ask you directly about work, but they will ask you what you do with your time, where you drive to etc etc.

They will no doubt mark you down for being able to work, but this would be frown upon at the tribunal stage providing your job/work does not contradict the issues that you claim affect you on your application

My advise is to be honest as whilst you may be declined you can go to appeal and honesty is the best policy in this case as anything you withhold will be sure to be frowned upon by a tribunal judge and you will only end up tripping your self up IMHO
