Good evening all,
Have received a pcn. The car park is confusing as it is easily confused between them. one part is for various retails shops and the other is for a leisure centre. She parked in what she thought was for the the shops. walked 50 metres to shops. Bought a few bits etc then left.
about 10 days later the letter comes with the info that this is a pcn etc, (I presume that is notice to the keeper). On the letter is a pic of the front of the car and the back. the pic of the back of the car where the front of car is facing one very long wall about 100 metres there are no signs saying at all stating parking etc. The pic of the front of car where you can see the other side of the car park about 20 metres away you can see a few white signs on the wall, but cant read them.
when you turn left past lesuire centre and shops there is no sign that can be read safely. drive 40 metres come to roundabout there is a sign on the left set back that cant read plus taking the roundabout safely is priority. when driving down on the left are some signs on a wall but two high up to be seen whilst driving, the long wall on right are no signs. As parked got out as said no signs in front as pulled up. Left car crossed road. wall that has some signs on there is no foot path so minding self plus signs very high.
Long winded I know. anyhow on pcn is says reason, "parked and left site"
have appealed to them using there appeal page, took a screen shot. used the template that doesn't name the driver and asks for a pcn. here is their response,

We write to acknowledge receipt of your recent online appeal, on behalf of the driver, appealing against the issuing of a Parking Charge Notice (PCN) to the vehicle.
We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:
http://www.legislation.gov.uk/ukpga/2012/9/schedule/4
We must therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable UK postal address. If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN. This information should be provided by 2nd February 2017. Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.
If we do not receive this information by the date given, the registered keeper of the vehicle at the date of event will be held liable.

The part in bold confuses me somewhat as I don't know if I am meant to communicate or not. The pic evidence they asked me to look at shows the car but is naff as already stated. I have returned back to the site and taken lots of pics. think there are a couple of big white ones that weren't there when there when pcn issued, plus they do look brand new.
I was surprised or disappointed that they wouldn't give me a POPLA code.
When I called in to complain the manger said that they just rent the land from the council.

they are trying to trick you into naming the driver, because once they know the drivers details they can take 6 years to "go after them" , eventually in court
you do not have to provide those details
geberally speaking , the advice is DO NOT NAME THE DRIVER
if the driver is not revealed , they will revert to their plan B which is to go after the KEEPER , thereby they will then issue the POPLA code (if they are BPA members)
this means they will have to have complied with POFA2012 to do so, or they will fail (not as easy as when some numpty names the driver)
so 98% of the time we say
DO NOT NAME THE DRIVER
dont make it easy for them , make them prove their case
plus if they saw somebody walking off site , they should mitigate their loss by warning that person (as was seen in the transcript about Rachel "dont forget your toothbrush" Coates at Wickes a few years back
wait for a time out and a popla code, meanwhile , start drafting your popla appeal and gather pictures of all that signage as evidence that it fails the CoP0 -
Standard begging letter for driver's details from PP. Ignore it and awai the proper rejection letter and POPLA code.

Good morning all,
Well we have got the rejection letter from them and the popla code. I am unsure as to what respose to make due to them saying,
"We write to acknowledge receipt of your recent online appeal, on behalf of the driver, against the issuing of a Parking Charge Notice (PCN) to your vehicle for a breach of the advertised terms and conditions"
here is there full reply,
"We write to acknowledge receipt of your recent online appeal, on behalf of the driver, against the issuing of a Parking Charge Notice (PCN) to your vehicle for a breach of the advertised terms and conditions.
We have considered your comments, and after examining all the evidence relating to the issuing of this PCN, we are satisfied that on this occasion the charge was issued correctly and must advise that your appeal has been denied, as the driver of the vehicle did not adhere to the terms and conditions of remaining on site as detailed on the signage.
You have now reached the end of our internal appeals procedure.

You now have three options;
1. Pay the Parking Charge Notice at the 14 day reduced amount of £60.00 by 17th February 2017. Please note that after this time the PCN will revert to the original £100.00 charge. Payment can be made online at https://www.pcnpayments.com or you may send a cheque made payable to Premier Park Ltd.
2. Make an appeal to POPLA - The Independent Appeals Service, by completing the form which can be found at https://www.popla.co.uk or write to POPLA - PO BOX 1270, Warrington – WA4 9RL. If you wish to appeal to POPLA, you will lose the right to pay the charge at the discounted rate of £60.00 and should POPLA’s decision not be found in your favour, you will be required to pay the full amount of £100.00. Your appeal to POPLA must be submitted within 28 days from the date of this email. For more information regarding making an appeal to POPLA, please visit https://www.popla.co.uk
By law we are also required to inform you that Ombudsman Services (https://www.ombudsman-services.org/) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such, should you wish to appeal then you must do so to POPLA, as explained above.
3. If you choose to take no action, we will seek to recover the monies owed to us via our Debt Recovery Service and this may result in proceeding with legal action against you or the Registered Keeper of the vehicle. oh on the appeal to the ppc i clearly stated that there were no admissions as to who was driving and no assumptions to be made.
where they say [photographic evidence, it only shows the car parked from front and back. it does not show evidence of parking and leaving or the driver walking of site.The word about the scammers is spreading like marmite here in the westcountry.

thanks, will try and do some of it today whilst at work. i have taken lots of pics particuly of where the car was parked where there were no signs at all along the whole wall. Also from the front of the car looking at the opposite side of car park where there are some signs but in the pics i got and the one they supplied is very small.The word about the scammers is spreading like marmite here in the westcountry.
