Decorating while tenants are in the property

    We gave them this as an option meaning that we are going going to kick up a fuss over it and run to the court. They are fully informed on everything! We have also discussed they do not have to let viewings into the property etc etc

    That's it. You cannot stop this from happening. If you try to, you may be guilty of a number of offences which means you could end up in prison.

    this is an investment property and you have a good tenant what's the motivation trying to liquidate.

    That should drive the options especially if you want to capture the owner occupier looking for a home rather than another investor.

    I am getting a feeling you have not thought this through that thoroughly.

    As I said before this property is let it is not in your control anymore. You cannot give your tenants the option of month to month because a periodic tenancy is their right if they don't want to leave when the s21 has expired. You seem to think that you have rights over this property that do not exist. The situation is that you do not have any right to tell your tenants what they can or cannot do in this property or what sort of tenancy they have. They have the right to choose not you. If you want possession of this property you have to wait until the tenants choose to leave or you get possession through the court.

    If you cannot wait to sell the property you will have to sell it to another landlord with the tenants still living in it. No you cannot decorate it unless the tenants ask you to.

    All I have asked is about decorating that is it. So yes! I didn't think though before posting on here.

    It's taken a while, but you seem to have finally (more or less) accepted the advice from post 2.
    Wait till the fixed term ends, serve s S21, wait for the tenants to leave, decorate, then advertise the sale.
    Though apologies :

    - you should, of course, serve the 21 two months before the fixed term ends
    - you'd then have to hope they leave, or follow the correct court procedure

    but the thrust of the advice remains.
