    Sorry, s170 doesn't apply as the car was parked and there was no driver at the time.

    Do you really need me to quote the whole of s170 when the title of that section is "Duty of driver to stop, report accident and give information or documents."

    There was no driver when the incident took place; the car was parked.

    And I guess you are going to maintain your stance that as it's the passenger responsible to OP's insurance won't be paying?

    If the OP wants their insurance to pay they can permit it.

    If they don't want their insurance involved and let the other party deal with their mother (if they could find out the mother's details) then they could equally do that.

    Have you given up on saying the OP has a legal responsibility to name her mother, keeping in mind she wasn't even driving when the car was parked?

    And if the third party makes a claim off the OP's insurance the OP can do what to stop that? Nothing.

    For a claim against the OP's insurance as owner of the car to succeed the other person would have to show their was some negligent behaviour by the OP or the driver that caused the damage. As we seem to now be of agreement there wasn't a driver it is just back to the OP.

    What was that negligent behaviour by the OP?

    A driver is the person who is in control of the vehicle. The vehicle does not have to be moving for a person to be considered to be the driver. Truck drivers parked up in bed have been prosecuted for drink driving because they've been in possession of the keys.
