Private Parking Ticket / Solicitors involvement

    Hey,

    I'm in a bit of a pickle.

    I received a parking fine from a private car park next to my work on Middle Street in Brighton a while ago and I've had a couple since and have just ignored them, it's Fludes that own the car park and they have a private company who check the cars, when I received the tickets I was told to ignore them, as they can't do anything being private.

    I've had a few letters from them, which they've never sent to the correct home address, so technically I've never received anything about it. Yesterday I had a text from Wright Hassall solicitors saying i need to call them as a matter of urgency.

    I'm a bit worried about it and not sure what to do, I've looked at forms that say, as it's a private company they can't do anything, but to contact the solicitors, I don't want to say the wrong thing and don't really know what to do or what to say.

    The car park backs onto my work, as I never park there for longer than 20mins, I'm usually dropping off music equipment or records, I've even spoken to the parking attendant, who agreed not to ticket my car, it's a really stupid situation as the car park is never full either.

    Please can you help as the fines are for nearly £400, which I can't afford :(

    They are not fines.

    The advice to ignore has not been correct since the law changed in 2012.

    Don't 'phone or text anyone.

    What is the name of the parking company?

    Why have the letters been sent to the wrong address. Is the correct address of the keeper on the V5?

    Did you get windscreen tickets as well as letters?

    What is the timeline of events? Date of alleged event, and whether there was a windscreen ticket. Date of notice to keeper.

    What happened when you complained to the landowner?

The first time they sent the letters to my boyfriends parents house, which I have never had my car registered at, they then sent it to my old house where my parents live, which the car is registered at, but I still have never received a letter to my current address.

    I received windscreen tickets, followed by letters.

    The first ticket I received was 20th October 2014, I've had 3 since then.

    A few more questions that will help:

    Do you have permission to park there, and/or did someone tell you top use that car park ? ( dont worry if not - its just to get an idea ) If you don't have permission to be there then i would suggest parking elsewhere, see paarkopedia for suggestions

    Are you, as part of your job making a deliveries to that site? you said you are dropping off/making deliveries, it sounds like that is why you are accessing the car park, in order to access to goods in/out is that correct?

    We need the dates of the tickets on the windscreen AND the corresponding date you received the NTK though the post for each ticket.

    The NTK goes to the place where the vehicle is registered. Do the addresses and dates tie up with the corresponding data on the V5?

    in addition you used the words Wright hassle and Worried, take a read through these forums and others such as pepipoo under Wirght hassle and you will see that you have nothing to be worried about

  • The car park joins onto our work building, we're a music venue, so constantly loading in and out of it, with band backline and records. The first time I parked there on my own accord, then I spoke to the parking attendant who said if I park to the back right I'm okay. I'm only ever usually there late at night. I won't park there if it's busy or full, which it never is and if I"m there for longer than 20mins, I'll park in our work loading bay, which is inside the car park.

    I've also emailed Fludes asking about permits, and they got back saying a price, but I only every park there once a week max when I really need, the other times I ride my bike in.

    What will happen if I keep ignoring the letters and texts? Can they send bailiffs round, or take me to court or anything like that?
  • My car has never been registered to my partners parents house, which they sent the first few letters to, the last couple of months they've sent them to my parents house, where my car has always been registered.

    I don't think I have any of the letters as the people at those addresses sent them back in the post, saying I no longer live there, which is true. I'll dig out the parking fines.

    Does your workplace have a right of access over that car park?
    it sounds like it may have such a thing, especialy if there a loading doors that open out onto that land.
    do you have a map link/google streetview?

    If you were on the land legitimately, then the parking company has no right to obtain/process RK data, and that could be a breach of the Data protection act

    Don't panic, what happens is they have to take you to court first and that does not mean you will lose.
    If you did lose, you have 28 days to settle otherwise you will get a CCJ.
    Right now just forget about bailiffs or anyone knocking on doors, it does not work like that.

    The job of members of this forum is to help you so it does not get that far.

    I am sure other members will not really understand what you are saying.

    The parking company get your info from the DVLA, that is the info on your V5

    There must a reason why letters were sent to your boyfriends parents address if the car was never registered at that address ?

    Any ref to your car registration will be sent to your parents address

    WARNING ...... You must get the V5 changed to your new address urgently as failure to do so could mean a £1000 fine.

    PLEASE ..... think about all this so others can really help you
