River Island Returns

Hi Guys,
My partner bought me some clothes over Christmas and unfortunately they didn't fit. (probably a bit of christmas weight)
I have been working away and only got the clothes a few days ago.
My partner then took the clothes back to have them exchanged to bigger sizes.
not returning them just to change them.
she was then told that she would have to return them for the current value so rather then the £42 clothes that was bought the value fell to £17 so was only able to purchase one top rather the top and jumper.
I don't know where i stand in terms of been able to return them they was bought in store but River Island are just saying it's under the discretion of the store manager.
any advice would be great

Did she buy before or after christmas? From their website:
If you need to return any items that you ordered at a River Island store, please take the items you’re returning, along with the Despatch Note included in your parcel or your till receipt to any River Island Store within the following countries within one month of your order date:
United Kingdom (excluding our Jersey and Isle of Man stores)
Republic of Ireland
The Netherlands
Belgium
Unfortunately we cannot accept returns to any of our other international stores.
You will be given a refund via your original payment method.

and yes she took the receipt with the price on that was purchased.
I just find it strange that they wouldn't just exchange the items like for like with no issue considering that's all I wanted.
I will have to quote them the reference above see what happens there because you are correct nothing about current value and within the date period.

As the clothes are now reduced in the sale, it could be that they are not available in different sizes.
They will usually offer the reduced rate onto a gift card.0 -
as the clothes are not faulty ( just the wrong size) they don't have to offer a refund at all.

That's not correct. River Island state at the time of purchase that change of mind refunds are allowed within a specified period, so this forms part of their contractual obligations.

So, nannytone IS correct.
RI don't HAVE to offer a refund under the CRA, but they do offer one, as part of their own policy, therefore OP should be refunded the full amount.0 -

Not quite. Bogalot is right - they only have to offer a refund if the purchaser complies with the terms of the returns policy, one of which will be that the items are returned within a given time period. If they choose to only refund the current sales price for returns outside the returns period then that is their choice, and the buyers choice to accept the offer or walk away with their purchase.0 -
but OP doesn't want a refund, only an exchange and has the receipt
I really think RI aren't playing very fair here as the customer has the receipt and items in original condition with tags on and they've explained (I should hope) the Reason for the delayed return due to partner working away
I would personally try their fb page and see if that gets you anywhere
Did your partner accept the £17 credit note?? if so they're may not be much she can do0
