Argos returns policy is a con - just sue them in County Court for a refund

    I am not asking for technical advice on this forum so stop getting your knickers in a twist.

    The point is Argos has a misleading Returns Policy, that is evident on many other forums with lots of other consumers are being fobbed off to accept faulty goods, and only challenging it through court action will make them even try to take issues seriously..

    You seem to have been lucky with argos not filing a defence as the case (and costs) is automatically found in your favour whether your claim is valid/has merit or not.

    Even had they filed a Defence, it would have been interesting to see their response and its merit given they refused to inspect, test, exchange or refund faulty goods returned in original packaging with receipt within the 30 days, and even if not deemed faulty the validity of their 30 day return policy claims, and I would have been prepared to test this at a hearing.

    There are issues of misrepresentation, breach of statutory consumer rights and breach of contract involved. Argos would really struggle in my view.

    I worked there as a Xmas temp a couple of years ago and from my experience the above post is spot on, I also am more than happy to shop there.

    As I said on an earlier thread life is all about attitude, good attitude generally gets good results

    Statute doesnt say anything about grovelling to a retailer who has sold you faulty goods and refuses to take responsibility. Consumer law gives a person absolute rights, and they are not conditioned to servility, and are enforceable in a court.

    There's is a huge difference between grovelling and being polite and courteous, I try to always be friendly and polite and have never had a problem with any company and my whole life is drama free. The rare occasion I've had need to have an issue dealt with I have without fail had things sorted quickly and amicably. Yet people come on here with an awful attitude and wonder why they have problems.

    I learned a long time ago to always approach someone new with a smile and especially if you have a problem always pay them a compliment. It is almost impossible for someone to be negative towards you when you smile and compliment them and generally have an air of positivity around you.

    It's not mis leading, a returns policy is over and above your statutory rights, you don't seem to know this. Their returns policy clearly states that they wont take back opened laptops so nothing misleading about it.


    You have a consumer rights issue which is not the same thing.


    They clearly believe there was nothing wrong with the lap tops so rejected your claim, two with the same problem? They were probably right.


    You next course of action was to take it to court, a default win doesn't mean you were right it just means they made a business decision on the cost of the claim v the cost of having £200+ per hour solicitors preparing a defence and attending court to defend it.

    It's you I would recommend should untwist your knickers, you sound totally entitled and confrontational.

    I wouldn't give you a refund if you spoke to me if I was serving you based on how you beat that keyboard in this thread.

    I wasnt offering technical support, but if it was say, I cant run X or Y software as the performance isnt up to it, then thats not grounds for a refund - at the moment we have no idea what grounds you are claiming under.

    You seem so sure of yourself, don't even know why you posted the thread, as people always complain, rarely praise so googling cases against argos is futile.

    Seems to be lot of Shills paid to lurk on these threads, laughably posing as "ex Argos employees" who "never had any problems with transaction and everything was 100% rosey". pull the other one.

    as do I and most people. If the retailer then blatantly tries to con you and refuses to resolve a faulty product issue, what do you do? As is reasonable, you use the law and go to court, not walk away like a coward and be fobbed off.

    You would and be forced to if I was entitled to one by law had you misrepresented and breached consumer law and/or contract. otherwise, like Argos, you may well end up defending yourself in court or get a ccj and the prospect of bailiffs.

    yes, both with the same fault, so presumably a manufacturing defect, but by law the Retailer who sold the product is still liable to the consumer.

    As for Bris: Argos head office filed Acknowledgement ticking the box to say "I Intend to defend all this claim", but then were either too incompetent to do so in time, or failed to come up with any credible Defence so could not. No listed company would allow a Default Judgment against it to occur simply for "business convenience" as you claim - that would be foolish and thats not the way its done by any corporation for a number of reasons (including their credit rating), the norm is to contact the Creditor and settle the matter either by paying up with a refund, or repair/exchange - Argos did none of that.

    Just to annoy you even more, I'll let you know on here if they pay up the ccj sum, or they try to apply to court to set it aside and for it to go to a hearing, or if they force me to send in the bailiffs.

    This post is for the benefit of others (and there are many as is evident on many forums) who have faced poor treatment by Argos and their misleading returns policy and attempt to evade consumer rights laws.
