Reject the car if they return it to you. If the money doesn't come within the agreed timeframe, then send a letter before action. If they still don't cough up, make a claim in the county court.

The money as our contract should have been with us Thursday just gone.
We were happy with the price totally, I think they've sent it to auction its not got what they expected and are now trying to get out of the deal.
Ive emailed them numerous times and il get our lawyer to do the same Monday morning. They've even transferred it through the DVLA,so my husband is no longer the registered keeper, put mileage on the car driving it I presume to auction then back again.

I could understand if you hadn't become the registered keepr and was simply "trading" the car on but as it seems you had the V5 in your name I don;t get why they would believe you are car dealers. Tell them that no car dealer registers the V5 in their name as you have done.
Edit, I see you have your solicitor on the case, in which case pass on any correspondence through him from now on.0 -
exactly, because we have bought it and sold it within 6 months apparently, its just an excuse to get out of the deal in my opinion.0

Sounds like they are just at it and now trying to cover there loses by putting it back onto you. They agreed to a sale, transferred legal ownership and have not paid up. You can use the online money claim service on the gov website. They will also owe you interest for each day they have not paid up. For the amount you would be claiming it, it would be £6.16 per day.
They likely will pay up though once they realise you are not going to roll over.

The claimed value is high, so the claim won't go through the small claims track. As such costs are not limited and (I believe) you can claim legal representation costs (if you win).
By the same token ... costs against you would also not be limited (if you lost).

the OP can use Money Claim Online for up to £100,00, provided the claim is fixed cost. I figure this would be for fixed cost of £28,000 plus any interest accrued.
The OP needs to just show that she has taken steps to resolve the situation. For example sending a letter before action.
If it goes all the way, the OP would need legal representation as they have taken the car, transferred the paperwork and not stood by there own terms and conditions. On reading them it appears that 4 days is the standard payment timeframe, though you can pay £29 for it to be same day...something to think about for anyone choosing this company. The terms and conditions also state that once the seller signs the standard contract the sale is binding.

If it was registered in your husbands name, and with private insurance, to a private address, and for a significant amount of time, what makes them say hes a trader and its a trade car?
So i cant see how you "cant prove otherwise"?
I also dont understand what is driving them to make such an issue of this? I'd a Clio 197 for a mere 3 months and i sold it to them. I am an ex motor trader so if they'd checked they could probably have found links to the provided phone number, address, etc. They didnt bat an eyelid at the time, and never pursued me afterwards.0
