    I think you've misunderstood my point ... I didn't say that OP couldn't use the small claims court (which is actually a common misnomer - it's actually a County Court claim), I said that the claim is too high for the small claims track (the limit for which is, I believe, £10k, hence small claims. Might be higher but it's way less than the £28k OP would be claiming).

    It's only in the small claims track that costs are limited; in the other tracks then costs can mount up and be claimable from the losing party by the victorious party (subject to approval by the judge).
