  • The payment of £26.14 to ControlAccount PLC has come out of my account. But when i check on the Fedex website, the amount of £26.14 is still shown as outstanding.

    Does the payment have an ID number on your bank statement? Give them that number and say its been paid.

    Hello everyone. I have a similar, yet different situation. One tiny difference - we are based in other EU country and do not have a department in UK. However we are a VAT registered company.
    My company has received a package from China to our UK warehouse (to a transfer company) around April 2016. It went through customs without any questions, as if there we no import procedures at all, and we did not notice any customs-related marks on the package.

    3 months later we get an invoice from FedEx with 12£ administration fee and 15£ VAT.
    We have noticed that VAT was calculated based on wrong value. Basically FedEx simply took a fake value from the package, that is always fake when you buy from China. Actual VAT should be higher, around 24£. It is important, because our accounting needs the numbers to match.
    So I have contacted FedEx, and, after bunch of offtopic automated emails, sent the correct sales invoice with specified higher value, and asked to change their invoice.
    Few emails, calls and 3 more months later, and we receive updated invoice with correct VAT. However we also received a second invoice with "amendment fee", for ~60£.
    So it takes a few more calls and emails, and calls again. I ask to explain what this is for and ask to cancel the extra invoice, since it was their mistake and we are not going to pay it anyway, because it came out of the blue. The support guy says "sorry, I can not help you". Then we wish each other to have a good day and hang up.
    One month later we receive a letter (also through the transfer company) saying it's a final notice, or else "court". And one more month later (today) we receive a fraudy-looking email from Accountcontrol PLC with phone number and request to call.

    Since:
    a) second invoice has absolutely no ground
    b) we have attempted multiple times to pay the first invoice and it was just endless hassle without results and already cost us more in time than invoice itself. Their website is just full of drama, there are so many steps and you get stuck on each one. You sort it out in one step and then fail in another. There have been at least 10 attempts and it took at least 2 weeks.
    c) we are based in overseas EU country and do not even have a registered address in UK....

    We are going to risk it. Now, should we pay?

    No. Why throw money away? They won't sue you even if they could find you.

  • I too have received an invoice from FedEx for a Christmas present bought from USA. At no point during the purchase of said item was there any mention of likely customs charges so this was not expected.
    I have contacted the seller and they sent back a stock response stating that they would not reimburse me - I didn't ask for reimbursement, in fact I didn't ask for anything other than them to warn future customers of a likely charge!!
    My question is, as I did not have a contract with FedEx am I liable for this payment?

    You bought goods from outside the EU so are legally obliged to pay the customs charges, ignorance of the law isn't a defence. What you are not obliged to pay is the couriers charges as you had no contract with them. Effectively they paid your customs fees up front and are now charging the £8-15 as an admin fee on top for the clearance work they did.

    I'd agree with that.

    You can question the Customs charge too, as you haven't said what the item was it's difficult to say. Most items will carry a charge, some do not.

    I've never understood why FedEx take so long to sort out customs charges. The majority ask for payment up front before they release the item.

    With my case, Fedex and ControlAccount both recognise now that i have paid the inital duty of £26.14. But they are Both still adiment that i should pay the remaining £40 to conrolaccount.

    Have there EVER been any cases of ControlAccount taking people to court or people getting CCJ's?
