Urgent advice: My car:Hell with buyer of my car - Please can someone advise me?

    I too would take him to the small claims court, sounds like OP has gone through a lot, shame that even distant relatives can't always be trusted, still that's families for you
  • Thanks to you all for replying , it really is most kind of you . As I said before, I don't mind what advice I get, and the truth is, after all, better to deal with. :-)

    Firstly, there is no signed agreement, and due to the lack of his contact with me, it was more or less dealt with by phone when I was in contact with him!

    Parking fines - yes, it was a resident's parking fine, as such. I did appeal, but as I am still registered as the owner, so I had to pay.

    Mark. The reason that I am concerned about an insurance claim is because of the way that he is now pestering me for the log book, ( remember that he has deliberately stayed out of touch with me, I even had to phone him constantly to remind him to pay the fines, which he did not).

    He told me that he needed the papers for the tax, but the tax is not due for ages. He then said that he needed them for the insurance? I am sorry, but I smell a rat, and I am not usually mistrusting of people. He is 'badgering' me, and I feel uneasy about the whole thing . The last few texts to me were very abrupt and I felt almost threatened.

    Yes, the person is quite right re the fines ,as they are due to him parking in Residents parking bays,

    Mr bad Example :-), there is no receipt, and the arrangements re: Payment of the car, was mainly via texts and one email. It was agreed that he would get the papers for the car upon full receipt of the monies owed to me. Why is he pestering me now, when he has not paid the agreed amount? .He is the one that is not honouring the agreement after all :-)

    At the risk of treading on toes…..would it be a valid argument that the agreement to transfer papers once all was paid mean that the transfer of ownership only takes place once all the money is paid?

    And if this is the case then surely it must follow the OP can recover the car with impunity.

    As much as I'd like to say get a friend to retrieve the car, it looks like your best option is to inform the DVLA, keep any texts you have that mention money and pursue him through the small claims court.

    If he starts to harrass you further or gets more intimidating then you are in a position to report him to the police. Again, keep any texts that may support such a claim and maybe a diary as evidence of any harrassment.

    Hopefully, once he realises you mean business, he will just pay up and leave you alone though.

    If you decide to pursue it, do not back down at any stage, as his sort will take advantage of any perceived weakness or hesitation.

    Good luck and sorry you have fallen foul of someone like this - I don't know how they sleep at night,

    Still don't pay it. Just tell them that the car is no longer in your possession, give them his details. Not your problem. If it went to court, you'd win. It's a bit like saying if someone stole your car and got a parking ticket, you'd have to pay!
  • Hi again everyone, and thank you all so much for taking the time to help me, I really do appreciate it, so thanks again.

    Simon, I contacted the London Borough, re the fines, and I phoned them and also wrote to them. I have received a reply from them which clearly states that I am liable, I wish I wasn't, but I am it seems.

    As I am unwell, I really can't cope with anymore hassle, and as the Bailiffs were due here, at my home, this coming Monday to seize goods due to this unpaid fine, I had no choice but to pay it. I texted the horrid person to say that I had paid because of the Bailiffs and he hasn't replied to this text ! Says it all, doesn't it? :-(

    I do hope that you have saved all emails/texts as proof. If so print them off ASAP so as not to accidently delete & take the swine to the small claims.
    He should be very ashamed of himself but I doubt his concience is troubled at all.

    I do hope you get this resolved but DEF start off with the small claims & once he knows it's go on record if he has done anything illegal re insurance/fines etc he knows eventaully he'll becaught out & be liable.

    A sad situation; this is why many people won't let a car go until they have the full amount of cash for it. If it's a distant relative can't pressure be brought onto them to pay for it?

    It's very cheeky of them to demand the log book when they haven't finished paying for it. I'd refuse to let them have the log book until it's paid for.


    Seeing how there are no written records of the sale and the OP is still the
    registered keeper I would be tempted to reposses it.

    This was my thinking. After all, you only lent it to him to see if it was suitable for work, right? He hasn't paid you for it, so he hasn't bought it.

    However, if he did shout "theft", I have no idea how the police would react. Is he likely to go to the police, or just accept the loss of the car?
    If you lend someone a tenner and never see them again, it was probably worth it.
