Return Faulty PCP Car

I got a Citroen DS3 on PCP last May with Evans Halshaw and I have been having problems with a faulty throttle sensor. The car has broken down twice since May already.

Would it be possible to return the car? If so would I loose my deposit money on the car?

    As they have clearly failed to repair the car then you do have the option of rejecting the vehicle. You need to speak to the finance company that you have you PCP agreement with.

    Do you know if I would be entitled to my deposit back if I did this?

    Why do you think you should get your deposit back, you've had 8 months use from this vehicle?

    I've only had the car since May. The agreement is for 3 years, I would have thought that I would be able to get some sort or partial refund of it?

    If you can sucessfully reject it then you, or rather the finance co. (remember the car belongs to them) will get a cash value for the new car with a deduction for mileage/age etc. If there's anything left over once the finance is settled then you should be entitled to the rest.

    I'd expect that the depreciation would mean that the current value is below what you've paid so far so all your payments have been paying that. I'd doubt there is any surplus which seems fair when you've been using the car for 8 months.
    Or did you pay a lump sum in at the start?
    Remember the saying: if it looks too good to be true it almost certainly is.

    Essentially it states that you should be refunded your deposit and any payments less the amount agreed for your usage, so it would really come down to how much the dealer is planning on deducting for the value. Again though you need to work with the finance co.

    The deduction must be based on use the owner has had rather than what the 2nd hand value would be, therefore depreciation shouldn't come into it.
  • Just an update to this,

    I did get the car "repaired" but yesterday on the A1 the car broke down again. Was very lucky that an exit was coming up as it was very dangerous as I lost all power.

    Been into the dealer today to hand the keys back and tell them I don't want the car anymore. The fault has been with the car in the first 6 months of ownership (had it since May 2016). The dealer is going to check what's wrong with it and then get in touch with me, but I know it's the same fault as the AA confirmed it for me.

    I'm gonna try and get my money back or at least most of it as I refuse to take the car back and their service has been appalling. I will take it to court if I have to.

    Have you spoke to the finance company? I would suggest you do they can sometimes be helpful.
