hss1980 - I did tell you earlier to look at post #3 of the NEWBIES thread for the POPLA appeal point templates, or read Bartos1976's thread because he put together his POPLA appeal using the POPLA appeal point templates, it is easy.

Help. been trawling through loads of site trying to get some info.

Just received a notice to keeper dated 21/12/16, PCN was issued 15/10/16. total of 67 days after. Have read all about transferring liability etc. Do I rely on the 56 day rule. Do I appeal or do I wait and see if they try and transfer driver liability to keeper? Any help would be great
Yes, you can use the POPLA appeal templates as well, if this is a BPA company, plus use the usual wording you will find talking about a NTK served too late. Easily found by a search like 'POPLA NTK 56 days'. If it's an IPC company there is no appeal worth trying but no-one is telling you to pay.

You nee to start your own new thread. My signature (below) tells you where to click to get back to page one to click on the 'new thread' button.

Assuming you haven't told them who was driving, they are dealing with the keeper! (In what capacity did you send the appeal?)

No...why does this thread appear to be going round in circles?

You are still looking at out of date stuff.

Start by finding the main MSE page, then work your way through the following, clicking on the Forum button first, then the links exactly as I have typed them. (Don't click what I have typed below, they are not links.)

Moneysavingexper.com/Forum/Motoring/Sub-boards: Parking Tickets, Fines & Parking/Sticky:**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? ** READ THESE FAQS FIRST!** Thank You!

When you have found the NEWBIES thread, check the bottom of the first post to make sure it was last edited on 30/12/16 to make sure you are on the latest thread.

Scroll down to Post 3 and find the template appeal points. Use all the ones that are relevant.

Hi all, i have been looking through the newbies section all night #3 an cannot find relevant information or templae regarding "face down ticket" please. Can someone please point me to the url please?

There is no template for that specific situation, but there is information here that may help.

    http://parking-prankster.blogspot.co.uk/2016/11/gladstones-pick-link-parkings-pocket.html

Gladstones pick Link Parking's pocket twice. Claim dismissed for upside down ticket

    C8GF30W7 Link Parking v Mr H. !14/11/2016 Port Talbot!

Mr H parked and purchased a valid ticket which he displayed on the dashboard. When he returned to his car he found a parking charge because at some time the ticket had turned upside down. This was the second hearing. The first was adjourned.

The judge dismissed the claim. He ruled that it was the responsibility of the parking company to provide sticky backed tickets and that he had already thrown out 6-10 of these type of cases which Link Parking had brought.

Different parking scammer but same situation.

Yes and post #3 of it says:
Cobble together a draft POPLA appeal to suit your case...

Easier than it sounds because we now have a number of POPLA appeal points covering the essential areas for appeal. They are in 'near template' state, but will need to be checked first against the circumstances of your parking event.

These are long on detail and when put together form a formidable block of text, deliberately so to scare off some PPCs who cannot be bothered to contest (fairly common).

Then it gives you the templates...no-one is going to literally lift them out of the post for you. THey are links right under that paragraph! Stop looking for templates about what happened.

That's because there isn't one because that point LOSES at POPLA...

I'm still not sure why you aren't using the template appeal points from Post 3 of the NEWBIES thread. The signage template alone is as long as the whole of your draft above.

This is what the signage template point looks like in Post 3, with a link underneath it to a gert long appeal point.

Signage (I deliberately go to town in this section, don't cut it down!):

You have only added in signage. What about the other template appeal points?

Did you reveal who was driving in your initial appeal? If you did then you can't appeal as keeper. If you didn't, you should have non-POFA 2012 complaint NTK, especially if you have never received a NTK (but only if the scammers don't know who was driving.)

Please tidy up your PoPLA draft and put it all in one post. You have so many that I don't know which ones you are trying to use. I suggest you delete the ones you aren't using and just replace with a line saying, edited, see later draft appeal in post ?

The signage one is correct and should be appeal point 1. You need to have a list of bullet points such as

    1) Inadequate signage
    2) Not the landowner
    3) No standing to bring charges
    4) Non-POFA 2012 compliant NTK (but only if they don't know who was driving)
    5) Dissimilar to the Beavis case
    6) Frustration of contract (the bit about the tickets being non-adhesive, but miss out the Parking Prankster's title.)
    7) etcetera
    8) etcetera
    9) etcetera

    1) Inadequate signage

Then put in the whole of the appeal point from Post 37

    2) Not the landowner
Then the whole of that appeal point

    3) and so on.

But first you need to determine whether you are appealing as keeper and therefore will not be naming the driver, or whether you are appealing as driver in which case you can't use Non-POFA 2012 complaint NTK.

Did you look at Bartos1976's thread where there is a ready made PoPLA appeal you can use and modify?
