Being made Redundant but leaving early
Comments
-
There has been a lot of confusion over when we leave. We have been told that we are employed with the company until 27th Jan but our last day in store is the 20th Jan.
The redundancy policy says:
'At the employees request and at the employers discretion, an employee may be allowed to leave before the effective date of redundancy and still be entitled to their redundancy payment'.
I did read this to the area manager and hr who just said no you can't have your redundancy pay if you leave early.
So just to confirm there's no way I can apply for a counter notice now at this late stage?
Thanks for your advice it's been a great help to me. This is my first time dealing with redundancy and it's been so confusing for me.0 -
The termination date should be in the notice to make you redundant.0
-
All it says is 'it is anticipated that this store could close completely by 27th January 2017'.0

Can I still apply for a counter notice now as I have not put anything in writing to the company? I have my final consultation with them tomorrow.0

Are you sure they have issued termination of employment notices?
if not you can't counter notice only resign.0 -
On the 7th December we were all called one by one into the office to see the area manager who informed us that the store is closing down and there are no jobs available in the company. She did give us a PowerPoint presentation which stated the lease was running out and the company are not in a position to renew it. It says the company will be seeking out alternative roles in the company but nothing is guaranteed. She said it is our responsibility to find work online which I have done. She has said that there are no vacancies so we are being made redundant.
There have been a few mistakes on their part. One being there was a position for a manager in another store and they said my store manager had to apply for the job and have an interview. When my manager contacted someone else at hr they said they were wrong and by law have to be offered the job. They don't have to apply for it.0 -
Sounds like no one has been put on notice their employment is terminated.
or maybe others have but not you as you resigned.
might be worth asking around if anyone has been given notice yet.0 -
How many people work at the store?
They may fall foul of minimum consultation periods.0 -
There are 8 altogether including one on maternity leave. We have all received the same PowerPoint presentation. My manager is being moved to another store and although they told us all there were no vacancies one of my colleagues has been offered a job within the company. We were told on the 7th, had a first consultation on the 14th with the area manager and a hr advisor and have one final consultation tomorrow.0

Only 8 so no statutory consultation period.
Looks like notice will be happening shortly.0
