    great , now appeal the PCN using the blue text BPA template in the NEWBIES sticky thread

    add a note that

    THE OCCUPANTS OF THE VEHICLE HAD TO REMAIN ON SCENE WHILST THE POLICE WERE IN ATTENDANCE AND THE POLICE VEHICLE WAS ALSO ON THE SAME SITE AND A CRIME NUMBER WAS ISSUED - ref :- 123/4567890

    ALSO THE HOTEL HEAD OFFICE HAVE BEEN MADE AWARE OF THIS UNFORTUNATE INCIDENT AND HAVE BEEN ASKED TO CANCEL THIS SPURIOUS INVOICE FORTHWITH

    PCN Number –

    I am appealing against the PCN issued against my vehicle for the following reasons.
    I was on the Metro Inn car on the 10/12/2016 due to the fact that we were witnesses to a serious road accident which happened right outside the hotel in question.There were two cars involved in the accident and i followed them onto the car park to see if anyone was hurt,by the time i got there the occupants of the car that caused the accident had abandoned their car and ran off so i waited with the couple whose car had been hit (car has since been written off) until the police arrived so i could give my statement.I am assuming that CCTV footage recorded our vehicles arriving on the car park and if so it should also show the police car arriving approx. 5-10 mins before I leave the car park.
    It was raining very heavily and at night so was unaware off any restrictions and more interested in that the couple in the damaged car were ok.

    no , because you may have identified the driver in your appeal above

    the emphasis here is not to dwell too much on "what happened" or who was on site , tell them nothing , no ammunition at all

    this was why I said use the BPA template and add the wording I gave you in capital letters

    if you add anything else to it , be careful on what is said , stick to the facts but not about who was there, or say THE DRIVER blah blah , bearing in mind you are appealing as KEEPER , assume I was the driver and I remained on scene whilst the witnesses talked to the police

    too many people give things away by saying I and MY , like you have done

    the DRIVER may have witnessed the incident , the DRIVER may have watched people run away , the DRIVER may have been told by the police to wait on scene until the police were finished with them

    learn to speak in the "third party"

    Hotel head office have denied car park is anything to do with them,even said it was a local council car park which is untue as i have checked.Local police cannot find any reference to accident even though i sat in police car on the night in question and gave statement,and the couple who i acted as witness for are not responding to my requests for crime number.How likely is my appeal going to be without crime number.
    Determind not to give these leeches a penny so if all appeals fail what is worst case scenario.

    Why am I not surprised?

    Have to actually attended the local police station? Plus how local are the couple involved are you? Is it possible to pay them a visit?

    But in any event, the PPC will have CCTV of the police car so I would of thought that should be sufficient to back up your case.

    In the meantime all you can do now is wait to see the outcome of the appeal. Even if that is rejected, you still have the POPLA avenue to use.

    If you gave a statement to the police, there will be a record in writing so you need to contact a senior officer as this is very important for you

    Worst thing is, you could lose at POPLA, although you would have to try VERY hard and be daft enough to name the driver in the appeal (please don't).
    How likely is my appeal going to be without crime number.
    CEL are easy to beat at POPLA by a keeper simply following the advice in the NEWBIES thread, using the template appeal points there. Talking about crime numbers is pointless, goes off at a tangent and implies who was driving. This was always much simpler than you are making it, a cinch to beat at appeal and often CEL give up first go.

  • Just received crime number from other party who were involved in accident,they have also received a PCN and their car was written off.
