  • I called the Stockport County Court this morming to make sure they are open. They are closed until tomorrow, 28th December 2016. The cutoff date for witness statements and evidence are today.
    Can I then email them instead? Will that be accepted?

    I tend to agree which is why I have sent the basic essentials for my case.
    Copy of Schedule 4, Copy of Popla 2016 review page concerning keeper liability, my medical diagnosis and one case history to augment my case.
    Basically, they do not rely upon POFA so they have to assume I was the driver. I do not drive due to mental health issues. Instead I use carers. On a strict proof they have no evidence I was driving, so the case falls at that point.

  • I have now had two unsolicited calls from B W Legal, which my daughter has taken, saying I am not available. The first one was before Christmas with an offer to reduce the payment! The one today they would not discuss with her, so I do not know what that is about.
    What I do know is that they will have seen my additional evidence and the recent cases they have lost at Stockport, especially the one which relates my not being the driver and putting them to strict proof, which of course they do not have.
    No doubt they will send another one of their lame letters making silly offers?

    To me, it sounds like they may be considering discontinuing.

    Stand firm, do not settle, is my advice, and we think they will then blink first (they will have to because I can't see you losing this one). If you pick up the phone, tell them you will see them in court and to stop harassing you, which is a breach of the Equality Act in itself.

    Increase the pressure on them, threaten them with an "unreasonable behaviour" claim.

    also, mention to them that they they may have obtained your details improperly from the DVLA and compromised their KADOE contract.

  • Well this morning I received yet another ridiculous letter from B W Legal. It is as though they are operating in a parallel universe from each other.
    The letter is basically one they send out before court action, i.e. a veiled threat that should I refuse to pay they will take me to court?
    Strange considering that today is their last day to pay the court fee for the court case to proceed to the hearing stage?
    I`m not sure how they operate, but the descriptions of incompetence on the Pranksters website do seem to apply to B W Legal.
    I will check in the morning to see whether they have actually paid the court fee and report back.
