PCN Smart Parking Matalan

Hi all
I today received a PCN from Smart Parking for Matalan in Stevenage. I was not the driver and although there are two photos they do not show the driver in either, parking was paid for but I don't have the ticket for proof, any help would be appreciated??? Thanks in advance

Have you complained to Matalan and asked them to intervene? Always complain to the retailer/landowner.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

and appeal the NTK with the blue text template too
so 2 forms of attack , but a landowner cancellation is preferable , asap ( so get onto matalan asap)0 -
Thanks for the reply Redx. The Matalan does have a sign outside of it though saying tickets can't be resolved in store, going to try and contact there head office.0

Matalan Head Office do cancel with a receipt or the spending on your Matalan card. The question is ... "do you want me to shop with you again" ... none of these stores can afford to lose customers.

I think I am going to appeal using the template below? I can prove I wasn't in the car from my Oyster card statement
"Dear Sir or Madam,
Parking Charge Notice number: XXXXXXXXXX
Vehicle registration number: XXXXXXX
I refer the above Parking charge notice which was issued to me on XXXX 2015. Please note that I was not the driver of the vehicle at the time of the alleged offence nor at the time that the two photographs that you have provided were taken. I decline your invitation to name the driver and I will not be paying your demand for payment for the following reason:
This is a non-compliant Parking Charge Notice – no keeper liability is established under POFA 2012.
As the owner, I have not named the driver of the vehicle or provided a serviceable address for the driver of the vehicle. As the registered keeper of the vehicle, I can only be held liable for the parkingcharge if the relevant provisions of Schedule 4 of the Protection of Freedoms Act 2012 have been satisfied. The Parking Charge Notice fails to comply with POFA 2012 Schedule 4 on several specific points.
I must insist that this Parking Charge Notice is cancelled immediately. Should you chose not to cancel the Parking Charge Notice then I request that you forward to me a POPLA reference code. "0
