    Because Beavis was about a specific car park with very clear signage - as the Supreme Court was anxious to point out after their judgment.

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Ive just been watching this, which, although is a few years old, explains the absolute basics of parking on private land (I thought this may be useful for someone): https://www.youtube.com/watch?v=IaTKVPwo06I

    I think the bit that gave me solace is ...

    ...the bit that's out of date! Sorry, no solace in that advice.

    We will give you solace!

    Ive just read my Notice to Keeper again and it contains the paragraph:

    that if, after the period of 28 days beginning with the day after that on which the notice is given— (i)the amount of the unpaid parking charges specified in this notice has not been paid in full, and (ii)we do not know both the name of the driver and a current address for service for the driver, we will have the right to recover from you so much of that parking charge as remains unpaid;

    Does or doesnt that cover me for a POFA defence? (obviously as long as I respond as the registered keeper!)
    Thanks for all your assistance!

    That particular wording covers them for 9(2)f or 8(2)f as you can see by comparing it to Schedule 4. Not bad IMHO.

    But that's just one requirement. Their PCN is probably not awful, IIRC, so you might find it's not bad for wording in other respects too. But the POFA also requires:

    - adequate notice of the parking charge itself, on clear signs (i.e. not £100 buried in wordy small print)

    - a relevant contract with the driver

    - a relevant obligation on the driver

    All of the above rely on clear signage, without which there can be no keeper liability.

    To quote some internet reviewer: Yes, yes, you have.

    This forum has already advised you for the princely sum of £0. The only cost to you has been to do some searching and reading to guide what you're writing in your appeal.
