Is the C VCS or Excel? Check the top of the claim form. Dont assume.0

Do the AOS more than 5 days after the issue date , post the issue date below , plus post the date the defendant did the AOS as well
Ensure a SAR has been sent out , to obtain the data , then start preparing the draft defence , taking note of all posts by member Bargepole , including his recent ones
Issue date 28 Jan.
SAR to be sent tomorrow.
Re draft defence and Bargepole: noted.
Thanks for the help.0 -

With a Claim Issue Date of 28th January, you have until Monday 17th February to file an Acknowledgement of Service, but there is nothing to be gained by delaying it. To file an AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.torontoboy45 wrote: »Issue date 28 Jan.
Having filed an AoS, you have until 4pm on Monday 2nd March 2020 to file your Defence.
That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence could be filed via email as suggested here:-
Print your Defence.
 - Sign it and date it.
 - Scan the signed document back in and save it as a pdf.
 - Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
 - Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
 - No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.

After filing your Defence, there is more to do...- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire. Nothing of interest there. Just file it.
 - Wait for your own Directions Questionnaire from the CCBC, or download one from the internet, and then complete it as described by bargepole in his 'what happens when' post linked from post #2 of the NEWBIES thread.
 - The completed DQ should be returned by email to the CCBC to the same address and in the same way as your Defence was filed earlier.
 - Send a copy of your completed DQ to the Claimant - to their address on your Claim Form.

0 - Sign it and date it.

I'm late with this, despite sending in an AOS and making An SAR.
the defendant was all for throwing in the towel and it's taken me a while to talk her around.
Can someone help me (total novice) construct a defence? No defence was entered on the court paper.
I may not be able to come back immediately because of tech issues so need the use of work/public computer.
Thanks.

You need your own thread if you want help, not jump in on someone else's, especially one which is at a critical point.laddie123 said:I'm late with this, despite sending in an AOS and making An SAR.

Thanks. If you want a template defence, go to the NEWBIES FAQ sticky, second post down, where a brand new one has just been written. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
