P.S. That date in para 3 should read 'Jan 2017'.

I can't decide if I'm dealing with weasels or idiots.

Their response is laughable; a few photos of the vehicle and copies of previous correspondence.

Needless to say, I've shot back, pointing out the ***cough cough*** 'deficiencies', suggesting they refer back to client and reminding them that I'll chase a stay if they try court.

Oh, and I've thrown in an SAR as well. It wouldn't be fair not to.

Ive just had a response re the SAR from the comedy turns at Excel.

They politely refer me to the updated privacy policy.

I haven't had a chance to go through it; will look later. My gut feeling is that the policy contents won't be sufficient.

Has anyone else thrown an SAR at these clowns and, if so, did it receive a different response?

The RK has been in touch. An LBA was rec'd on November 12 (dated the 8th) and due to a combo of her being out of the country for a few weeks and a bout of illness she didn't respond.

Is it too late to make a rebuttal?

No , not too late , the RK should also email a SAR to the DPO at the PPC as well , attaching redacted copies of recent utility bills , or a copy of the V5C as proof of I D under the GDPR law , if not done previously

    Thanks Redx.

It's already clear that the LBA is non-compliant.

The RK is invited to use the Reply Form offered by Excel but she's getting a 404 when she tries to download and an email address isn't offered as an alternative.

I'll have to deal with this when my working day is over.

As expected, the Claim Form has been delivered to the RK.

I've just spent half an hour scanning posts relating to the £60 abuse of process (which - naturally- has been added) and intend to highlight m'luds' dim view of this on the WS.

Excel have ditched the services of BWL and gone in-house.

I suspect a lot of work will be needed but bargepole's template will surely come in useful.

Before I shoot off on another job - quick question: apart from acknowledging receipt on moneyclaim (which I can do now) is there anything I need to do immediately?

Do the AOS more than 5 days after the issue date , post the issue date below , plus post the date the defendant did the AOS as well

Ensure a SAR has been sent out , to obtain the data , then start preparing the draft defence , taking note of all posts by member Bargepole , including his recent ones
