That can come later, on a forum I think it's enough right now that people defend and win because they come here with little time and a claim can wait. They can make a claim for £250 or more under the DPA after they win, if they are so minded.
I would - but not everyone would - and also, a counterclaim forces the case to a hearing which most posters here will not be comfortable with (after all the forums are getting these cases discontinued in many cases which is the first step most people would wish to achieve). And people have six years to claim under the DPA, plenty of time to serve revenge.
So I reckon a claim afterwards suits the usual nervous Joe Public, unless you think otherwise IamEmanresu? We can always discuss it off-forum anyway. I do have a couple of cases I'm working on which would suit a counter-claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I would have counter-claimed personally, but my friend was scared about going to court. She really didn't want to go, so hopefully she wont have to now.
That's good to know that she has time afterwards to do so.

Yes I think most posters here would prefer to win the defended claim or get it discontinued first, then spend time putting a claim together in a calm way afterwards, if they wish to. After all they'd have years and could even wait to see the level of success first, before they have a punt.

Just received a letter from Gladstones, enclosing a copy of the N180.
We haven't yet got one from the court, is this normal?
In the to do list it says, both the claiment, and defendant get the N180s.
Shall I ask for one or print one off myself and send it back?
I haven't been told the date for when I have to return the N180, just a letter from the court acknowledging the receipt of the defence statement.
Please advise

See hopsfield's thread and Gin and Milk's thread, two of several that have already covered how to handle this stage.
Gladstones send a misleading template copy N180 and forms from a N159 (hearing on paper = no thanks) to confuse matters to try to push for the case to be heard on the papers or at the Claimant's local court; this is before they or you have even had your N180s in the post! I haven't found those threads you suggest, however, I followed Bargepole's advice in filling in the N180 and have received a letter from the court saying that it's been transferred to the local court as requested by myself.0

You need to learn how to use the 'forum search' and 'member search' functions, or you will struggle to be able to research witness statements on the forum. It is vital to be able to search & find stuff with just a member's name or a keyword.
It is easy to use the forum, take a look at the headings above the threads on page one and click on them and play around with what you can search for (NOT here on your thread). Okay, I'll check out the search facility.
Got a response from the DVLA; they said it was 'private land' and they don't get involved in civil actions etc..and referred me to the IPCs code of practice.0
