    The original claim was made in Northampton. Thats always been the case. thats where CEL made the claim.

    I discovered it, and made application to have the set aside done to Northampton

    The next I received was a letter from Northampton CC saying the case was being transferred to Birmingham CC, whereupon I subsequently received a hearing date

    At the hearing (In Birmingham) the judge agreed to set aside the CCJ on condition I made a defence for the claim.

    The defence to the claim was subsequently lodged with him / the court

    So ........ I dont understand the "make up your mind" comment. I'm perfectly aware of what I am saying

    Yes, thats all the court could let me have, the one that says debt and damages. In fact I was lucky to get that as the normal lead time for getting a document is 2 weeks which was over my time limit and legal guy said I needed to see that before putting in claim defence. Someone at the court took pity on me and sent me what they had.

    NO , northampton are obliged to tel you the history of a CCJ without a 2 week wait , simply a default was granted on XX date at XX court ,

    so WHY was the ORIGINAL claim transferred from a default on paper at northampton , to a HEARING at birmingham that you failed to attend and a default was granted?


    if the claim was sent out to an old address and not answered a default would have been done on paper at northampton NOT at a hearing in birmingham

    Why was it transferred? Because the court chose to do so when they saw I was making the application to them

    If you mean by defualt, the original case for the "ticket" that ended with my CCJ, then yes as I said it was held at Northampton. Only transferred to Birmingham when I went for the set aside. ive said this many times here now.

    I asked for paperwork, they said 2 weeks minimum waiting ... I can do little more when I am speaking to a call cantre, as you cant talk to the court any more. It may be that they have an obligation, but that doesnt mean they are living up to it with the workload. I couldnt even make an appointment to go there as the court only makes appointments for emergencies.

    With respect, I'm not sure what we are achieving with this conversation. It is what it is. What has happened, has happened ... not as you say it should do, but with no input from me and nothing is going to change it

    had your ORIGIONAL story been true , then things would be completly different

    There was no original hearing held at Northampton! The original claim was dealt with by way of a judgement by default without a hearing.


    Birmingham Court was the venue for the subsequent set aside hearing


    Now there is to be a hearing of the original claim which the claimant has reissued following the OP's successful application to get the judgement by default set aside

    My original "declaration" was true.

    You seem to be accusing me of being dishonest now!
    I have always said that the originakl claim was at Northampton and was transferred to Birmingham. That is what happened.

    I am someone who doesnt know the system and am grateful for those on here and elsewhere that are being helpful. As someone who doesnt know the system, as far as I am aware a hearing was held at Northampton where a CCJ was put against me. If there wasnt a hearing, fine .... but I still had a CCJ put against me in Northampton. I've told you what has happened many times. Others seem to understand. You dont.

    Nothing YOU have said has been helpful so far and you have come over as antagonistic and argumentative. It's been stressful enough without having to deal with you. I'm just pleased that there are people on here that are helpful and I am most grateful to them.
