Having posted this on another older thread, putting it up here for discussion as I am disgusted at the actions of this company .... not so much for me but others who may be more financially challenged.

I'm going through a legal battle with CEL at the moment. I'm guessing the car park mentioned in the other thread is in Kings Heath Birmingham.

Ive just been there to investigate. Even the staff at the local shops are fed up with CEL. The signs up there are a bit like a cartoon joke picture and they are done in a light pastel colour so as not to notice.

I've shopped at Homebase in the past and Ive been a member of EasyGym. They took action against me a year after the alleged offence, but havent notified me of anything at any time. So I end up with a CCJ (which is now overturned) without my knowledge.

Ive now got to fight the original offence, as I still have no idea of the details whatsoever - CEL dont talk to you or communicate in any way at all.

They are running a numbers game. The more claims they make the better they are. Theres been a newspaper article about it recently

As of yet I have no idea what I'm fighting. As i say, Ive been to court and got the CCJ overturned. I'm now putting in a defence for something I dont know anything about and I'm not sure where it is leading me. Ive had some good advice so far from a legal guy elsewhere

People need to be warned. CEL can even try it on if you park outside a space. It's their way of making money. As I understand it in the Kings Heath car park they dont charge the landowner for running it, so you can guess where they hope to get their income from

They also operate under the name of Creative Parking and apparently they have been known to operate at

Co-operative (Co-op) (Now sacked apparently)
McDonalds
B&Q
Sainsbury’s
Morrisons
PC World
Travel Lodge
Premier Inn
Brewers Fayre
Petrol stations
Retail parks

If anyone ends up in the same situation I'm happy to share what I know.

    you list the coop as being a customer , that shoud read EX customer!

    the coop fired CEL and in retaliation they issued 100s of claims , at first the coop paid them all , then stopped and things got out of hand read:

    no one knows what happened to that case , it disappeared from records !

    sounds like cel have been booted from your site as well , and are retaliating

    several court cases against them , one earlier in scotland where the UKs finest trading standard made a right %alls up and CEL walked away

    Ive had some good advice so far from a legal guy elsewhere
    Hope he told you to defend as registered keeper without naming the driver because CEL can't hold keepers liable?

    He knows about the POFA etc.? Not many 'legal guys' do and with CEL, it's a keeper's best defence of all, regardless of details, signs etc. If it's the Parking Prankster or the BMPA then great!

    according to the other thread , cel had been replaced at the site , , have thay been replaced or is CEL signage still there?

  • CEL signeage is still at the Kings Heath site yes, as well as the cameras. CEL operate under a few names, and these include Creative Car Park, Parksolve, Star Park, and Versatile Parking .... so now you know, it hasnt been taken over they have just swapped names. the signs still say CEL
  • @couponmad .... no, they dont know who was driving. They havent communicated with me so all they have is my defence which doesnt mention this car park because I dont know 100% that it is where the issue happened.
    One thing you learn quickly is that CEL dont like talking to you
    A number of people have access to my car, so in reality I guess the driver of the car could be in question in any event

    I do know the alternate names of CEL , however the manager is convinced that his contract is with versatile parking NOT cel

    so far you have just explained to regulars alternate names of CEL , if you want help on writing a defence then more info will be needsd

    date of NTK (date delivered not posted)
    did you appeal to them at the time
    did you get an POPLa code
    did you use it
    what was the outcome

    Right, so you know how to win this at a hearing? CEL have no case against a keeper and you have no obligation to give the driver's name.

    Read Lamilad's thread about his court win yesterday at Skipton, in a similar situation v Excel (who also do not use POFA NTKs).

    I dont have any information
    I never received a parking notice. I never received a reminder
    I didnt know I was put into court
    I didnt know I had a CCJ until I applied for a credit card and was rejected

    CEL have ignored every recorded delivery letter, every email, every telephone message. My defence has gone in with the advice of a solicitor who has experience with parking problems on the basis I was never served, and never communicated with etc etc. Its the only defence we had as CEL say nothing
