UKPC Parking ticket in my own space - with a twist...

    The OP should not pay the £15- they have absolutely no case at all and the 'reduction' is an implicit admission of this.

    The OP would definitely not be acting unreasonably; on the contrary, UKPC would likely have costs awarded against them for pursuing a frivolous and vexatious claim.
  • I just checked the documents from when I moved in.

    There's definitely one saying something to the effect of:

    "The parking is managed by UKPC and you must adhere to terms and conditions of parking at all times. Enclosed are two visitor's parking permits for you to display in vehicles."

    So I don't I think I am liable as I have followed through with displaying the permits, as can be seen in those pictures. It's not a case of forgetting to display permits, or permits not visible through the windscreen, or they fell off the windscreen, lol.

    Anyway, tomorrow is the 27th day from the date of the letter, and I will send in my POPLA appeal.

    I still want to argue point #5 because surely my case is different from the Beavis case. The Beavis case was overstaying the free 2 hour limit at a private car park, my case is parking in my own spaces (which I have every right to) and it would have been free anyway, so UKPC did not lose any money because I had parked my car in my own spaces.

    Why are you using technical appeal points if you are 100% following the guidance given to you by the landlords? If you had valid permits displayed and the PPC photos confirm this, any technical appeal points (for people who have actually broken so called t&c) simply confuse and complicate.

    I agree with GD, just stick to the facts.


    Popla then have two choices, they can either find for you or the PPC. If they find for UKPC. they will be doubting your word, calling you a liar, and favouring a company which has been investigated by the City of London police for fraud, barred from access to the DVLA data base, and lost in court dozens, perhaps, hundreds of times.


    Why bother whether they have a contract or not, whether their signs were the right size, just tell it as it is.


    If you win at Popla invoice them for wasting your time.
    You never know how far you can go until you go too far.
  • I received a reply from UKPC today responding to my request to explain on what grounds they are upholding their parking ticket. Once again they simply say "As per our previous letter, we can confirm that we have made our final decision regarding your appeal." So they do not explain why my visitor's permits were invalid (if they were indeed invalid at all).

    I had wanted to include all the technical points to POPLA so that if POPLA were to be as unreasonable as UKPC, then I could get the ticket cancelled through one of the other points. But you guys seem to think that POPLA will be reasonable and back my side?

    Let me see if I understand the situation properly :


    UKPC have tried to screw you over - you have caught them out - they are now generously "offering" you a chance to pay them a consolation prize of £15 for trying to cheat you and not succeeding.


    If I were in your shoes, I would be hanging on to my £15!!

    You are missing the point. They are still maintaining you have a contract and are suggesting they discharge the obligation to pay them £100 by offering to forego their "rights" by accepting £15.

    Clearly if you intend to go ahead and appeal to POPLA, it will cost them £27 (hence the £15) but if you fail at POPLA, they can come after you for the amount on the signs which is £100 plus £60 usually.

    The decision needs to be based on facts, not what you consider to be logical as law and logic sometimes don't meet.

  • I have followed the advice of Guys Dad and The Deep and just stuck to the facts and didn't include the technicalities in my appeal to POPLA.

    But I am wondering if there is a time limit for UKPC to get the vehicles' actual registered addresses from the DVLA, because the current address they have for me is simply a temporarily rented flat.

    They have to send you the NTK after 28 days but before 56 days following the parking event. So, based on 14th August this would be between 11th September and 9th October.
