Hi Can somebody help me out with this please....
I received a PCN from Euro Car Parks an was advised to ignore it....
I have had a follow up from them increasing the fine from £60 to £100
They claim the vehicle was parked for 55 mins.
the vehicle in question used the garage to fill up but unfortuneatley there is no recepit.
how should i proceed ?

I have read it but found it confusing..I have since been told there are signs and they are not in small lettering
so do i simply send this as a start point ? as it contradicts the case..thanks

I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have omitted clear information about the process for complaints including a geographical address of the landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
I have kept proof of submission of this appeal and look forward to your reply.

What do the signs on the site actually say about what the terms are?0 -
Yes the car was parked there alledgedly for 55 mins and the signs apparantly state a maximum of 20 mins0

Right. Well firstly then you need to get a picture of the signage somehow.
From your username, I'm assuming you live broadly in the area? You're not in Newcastle of somewhere like that?
If you happen to be passing by again, call in and get some pictures of the signs if you can, as they don't seem to be on Streetview.0 -
