ParkingEye ANPR -v- Men

Hi all. I've hunted through the board but can't find any similar threads so posting here.

I got a PCN from ParkingEye for parking for 20 mins at Aldi however neither I nor my car were there. Their date stamp cannot be correct. I did not visit that Aldi on the day in question. Consequently, Aldi store or head office would not help, ParkingEye rejected my appeal, and so did POPLA (see below).

At the time my car was allegedly at Aldi I was doing voluntary work for a club with my car on their ground 4 miles away, and the people I was there with have given me a signed letter stating so. Clearly I can't produce anything documentary like receipts to evidence this as all I bought were a few drinks with cash.

If PE bring this to court (which I expect to happen) can this letter be used as evidence or will they have to attend? Is the idea of the ANPR against me weighted too far against me? Their pictures certainly show my car, but it's not there when they say it was.

There were spectacular thunderstorms in this area on the day in question, could that have affected it?

Any thoughts on my predicament anybody?

As a postscript, when I got PE's "evidence" file at POPLA stage, I was given 7 says to respond to it, saying they'd "progress the appeal once this time has passed" I responded on the 'track appeal' section saying I would reply by post as I couldn't upload documents. However, they made their decision on day 5 without giving me opportunity to send anything, and despite complaining, that was it.

    parking eye at aldi , be a first if ever there was one ,

    if you are thier fist aldi case , then tell the judge the truth , and take reliable witnesses , chief contstables and MP are great!


    PE as a rule do not pursue aldi cases , proof of this statement will be the recept of letters from the likes of DR+ rather than court papers

    Indeed. If they take you to court they are questioning your honesty.

    If you are an honest man counter claim for being hauled in front of a judge for no reason. Take with you 17 character references, although I would avoid MPs and Chief Cons, some of them lead very colourful lives.
    You never know how far you can go until you go too far.

    the fact that you didn't visit is irrelevant, Parking eye are there acting as agents of ALDI, and as such ALDI are jointly and severely liable for the actions of their agents
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    Not sure I'd get anyone actually attend court with me, which is why I hoped the letter would do.

    POPLA declined my appeal on the grounds it was an "evidence based service" and I had not provided evidence, whereas PE had supplied evidence showing that my car "was there"

    If you mean why they didn't allow 7 days, they say it was because I should have forwarded everything when I submitted my appeal and that I ticked a box saying I couldn't "edit" it. (I was not "editing" my appeal; it stood as stated, for the reasons I stated, but was going to forward evidence to contradict PE's file)

    Forget the idiots at PE, so did you appeal in a proper manner or actually no appeal with logic
