It doesn't matter how you get over the line, it matters that you did.

Sounds like you had a judge who wasn't likely to be convinced that you were OK to park there, but recognised that as you'd put them to proof they needed to prove it (and they couldn't). It's litigation, that's the unpredictability of it.

I say chapeau. A lot of people don't fight these. You did and they didn't beat you.

You may be worse off in £££s in principle, but you didn't have to pay them. They are much worse off. Their business model fails when not only do they fail to recover on tickets but they have to write a cheque and keep someone out of the office all day. They are also on notice that they may not have a valid contract to cover the whole site!

As quoted elsewhere - a win, is a win, is a win... Now go and get a pint.

Cheers i get what you mean, i just wanted to test my defence and prove them to be what they are, instead they knocked themselves out. Also concerned for my friends who didnt get to see if my defence would hold up and did see PCM get a critique on how to better bring their offence against them

A win is a win ... it doesn't matter how you achieved it.
was a massive waste of resources on you guys part and mine
No it wasn't, you got the win which makes it worthwhile and if you hadn't defended who knows whether what he said was true. Also remember, he did read your WS, he said as much, which means what you wrote probably tipped him off to problems in their claim. On top of this, all the research you did and all the help you got can be passed on to your two mates who can use it to win as well ... so hopefully 3 wins. I very much doubt the claims against them will be much better.

What time was your hearing, chances are you got the DJ at a bad time and he may just be one of those DJs who are thoroughly fed up of these PPC claims.
All this aside, thanks for everything guys, im just sorry this is kind of hollow as it was a win on negligence of PCM and not anything I said or did...
To be honest its even more satisfying winning on their incompetence (not negligence) than having to fight for it IMO (ask Lamilad) ... and remember you might be down a bit of money but they are down a whole lot more than if you had paid ...

Well done, seriously, really well done. I firmly believe your well prepared WS and their rubbish one probably tipped the DJ off to something that he then looked into and they couldn't answer.

The claim was scheduled for the 10AM slot, we were seen at 2PM, we sat there for 4 hours for a 10min meeting.

But thanks for the words, i think once the initial disappointment at not getting to speak and not getting more expenses than id have earned at work have passed ill feel differently

Court running late, maybe the DJ saw this as a slam dunk for making up time!

Well, I doubt Ms Philpott is feeling much better and unlike you the passing of time won't improve the situation (especially when she writes your cheque)!

If your mates need advice tailoring your defence for their purposes send them on here and link their thread to yours so we know. When are their court dates?

Thanks, yeah to be honest someone in the waiting room asked her 'how often do you win' and she said '90% of the time'....

By the way how do i get my money? in the post? i didn't really hear the details.

Any yes they will make threads soon ill get them to link this one so that you guys are aware its the same property etc. My concern is my defence wasnt tested against their offence, its like going into a boxing match and winning because the opponent punched themselves in the face, you dont know how your going to fair if they dont next time...

Possibly as accurate a statement as those in her WS! :) I very much doubt it and even if it were true then that puts you in the top 10% ... either way you should be feeling better now!

I think you get the judgement posted to you and the DJ would have said something like "Costs to be paid in XX days". Generally you will get a cheque in the post. If you don't get it come back here and there will be a queue of regulars willing to show you how to submit a warrant of control order on them! :)

Yes, definitely get your mates on here, its highly likely they will win also with the help available on here.

I can't wait to see the next claimant particulars as I would not be surprised if they are just a copy of yours ... this is not high end litigation ...
  • this is not high end litigation ...

Indeed not. Stunned that a defendant can bother to spend money on a land registry search, but not the claimant!

Their case failed to even start because they didn't spend £4. Lol.

Cheers guys, ive sent them this way and provided them with all my documents so they have reference to everything done in this thread, their situations are both slightly different, one a resident and one partially in a private space, but nethertheless if PCM dont patch up this road owner issue, thatll be where to attach again
