    And after 180 days?

    The law also very clearly says "you can’t mislead or harass consumers by, for example:
    • including false or deceptive messages
    • leaving out important information"
    (That is from The Consumer Protection from Unfair Trading Regulations - which is also in EU law BTW.)


    So, my warranty was clearly stated as being 12 months.
    AND was clearly stated as being "hassle free".


    Perhaps you can explain which part of either of those statements (which encouraged me to purchase the item) eBay will uphold?
    Since NOT upholding what is stated in an eBay listing is therefore making the product description misleading.

    A warranty can be what the seller/manufacturer wants it to be. If they say they won't refund postage then they won't refund postage. That's not to say it isn't fair. But if you are going the warranty route, that's what you have to abide by.

    If however, you want to further your claim with legislation, then you need to abide by that. If the item has been in your possession for more than 6 months then it is down to you to prove there is an INHERENT fault with the item. Can you do that?

    They might have a rubbish attitude, they're seemingly not an amazing seller, but that doesn't mean they're doing anything wrong legally.
    You're obfuscating; why?

    Look; if I go into a shop to buy a bulb & it is guaranteed & becomes faulty within the guarantee period I take it back. With receipt. And get replacement or refund.

    The law makes this the same for "distance selling".
    But eBay will not uphold this.

    The warranty is as it says on their pages.
    Look at it.
    That is as much as I got.
    Who then decides "if the warranty/guarantee covers you."?
    Not myself, obviously.

    So "Covered by 12 month no hassle warranty."is what it says.
    Hassle free does NOT imply returning at my own (considerable given the value of the item) cost; nor does it imply that I must first ask for (and be denied) a postage contribution.

    It is my assertion therefore that such sellers ARE in fact "doing wrong" by advertising such a warranty that (certainly in my case) they appear to have little intention of honouring.

    Legally?
    Being extremely generous, that is debatable.
    Morally however it is certainly not.

    You seem very confused.

    Paypal and Ebay do not offer warranties/guarantees on items. They merely guarantee you get the item you ordered.

    The seller warranted the goods.
    Sold on eBay.
    No confusion there at all.

    You seem confused between buyer protection, warranties and legislation.

    Ebay and Paypal do not offer any form of warranty on a basic transaction. You can buy Ebay square trade warranties, but this is a separate thing entirely. Ebay and Paypal both offer you a guarantee that you get the item you purchased. That's about it. If you'd not received the item both Ebay and Paypal could have helped (within their timescales). If the item had been faulty ON ARRIVAL or broke on FIRST USE, they would have helped.

    But, you have had use of this item and it has failed. Therefore your options do not include Ebay or Paypal.

    You've been given some helpful advice, why not read it instead of cherry picking bits of text.

    You know if the warranty covers you by reading what it says.

    It's not complicated.

    The law gives you 30 days, as does ebay.

    After that, you have to prove their was an issue when you got it. That can be very difficult and it's not always fair, but that's the law.

    If the warranty states it covers your situation then the company should do something. If not you could take it further, but over a cheap item it's probably not worth it.

    Hassle free doesn't have anything to do with postage costs. It's no hassle for you to pay for postage, it's very simple, you just don't feel it's right to pay out. All hassle free means is they have a straight-forward process in place. You state issue that is covered, they'd say send it back at your own cost, they refund when they get it.

    Where it's sold is not important so you are just confusing the matter.

    The warranty is with the seller only, no one else, regardless of where it is sold.

    Ebay is in no way involved with the warranty. They can't do anything.

    Their guarantee, as stated on Amazon. Clearly says in caps buy pays postage costs.

    "Returns Policy

    If for any reason whatsoever, you are not completely satisfied, please ship items back and we will gladly refund your purchase price.
    Please make sure they are returned in perfect, unworn, resealable condition.
    If for any reason you have bought a wrong product we will charge you a restock fee. This fee varies for each item.
    BUYER IS RESPONSIBLE FOR ALL RETURN POSTAGE COSTS"

    Their Amazon return does state they will refund upon return, but their are conditions and, again, it states buyer pays for postage costs.

    On ebay it states at the bottom of the listing, "Unwanted or incorrectly ordered items must be returned at buyers cost, as received and in a re-saleable condition. We won`t refund postage cost, our postage costs will be deducted of FREE P&P items as well. If item is NOT returned in a re-saleable condition or damaged, we reserve the right to decline the return or deduct costs before a refund. Buyer is responsible for postage costs of the new items when exchanged."
    So if the item is basically unused or as-new ("are returned in perfect, unworn, resealable condition.") they should accept a return with no hassle, just pay the postage and have it returned.

    In other words, the warranty is pretty meaningless if you're over 30 days and the item has/gains a fault or the item is no longer in perfect condition.

    Which is why I posted; you are quite correct in your summation but the result is .... irritating.

    As I say in my OP though, firstly a very poor attitude from this seller.
    And secondly had I bought through other than eBay and this seller, my experiences suggest that I would at least have received prepaid postage.
    In fact I had to arrange just that via Amazon recently - for a much more expensive purchase.
    Which was arranged AND a replacement provided very promptly.

    The moral of this post?
    If you want to buy anything that matters to you, do not use either eBay or third-party sellers on Amazon.
    Because the so-called "warranty" that might be offered will be meaningless.

    I do hope that this makes prospective buyers at least a little more "wary" before commiting to a purchase.

    It's sad that you had a bad experience. Unfortunately that can happen regardless of where you shop; online or in store.

    With every item there's always a chance of one being faulty. Every store will also have it's own policy once the 30 days is passed. Some will refund, some will only replace, some may accept a return as you have a reciept but as a one off, others may refuse completely.

    All you can do is read what the seller is actually offering so you know and hope that your item will be fine.

    Avoiding all third party sellers and ebay is going OTT.
