Tenant say they will not pay rent ,if carpet not change

    Unless both you and them missed how poor the carpets were in the rest of the upstairs then they don't sound like good tenants. You can't be blackmailed into doing what they want every time by the threat of not paying rent. So change the carpet you agreed to and tell them they need to pay their rent or you'll have no choice but to evict them.

    If they don't pay rent then the day after the second month's rent goes unpaid you can issue a S21 and then apply for a court date a fortnight later. If things go quickly you can have a court date before the end of the second month and then get a possession order with 14 days notice and an order to pay rent until their last day.

    If they don't pay rent you could even issue them a S21 part way through the first month. Even though it can't expire until the end of the fixed term it will let them know you're serious and possibly nip the problem in the bud.

    Your enthusiasm is commendable but deregulation act 2015 prevents the above.

    S8 g8 straight away or 10 in one month and one day after first rent payment is not received

    Op did you protect the deposit, issue information, epc, gas safety and rental guide?

    01 Octorber 2016 rent the property .
    Before rent I promise one room carpet I will change.

    After two week ,received a text he can not live the property ,staying out side and will not pay rent if not fixed by two days.

    No reply sent to tenant yet for text message. Thinking to reply by email.
    But ordered to change the carpet for one room to carpet shop.

    Is there something you're not telling us about this carpet? Is it unusually old, disgustingly dirty, hopping with fleas?

    So, send them a letter or email confirming that, as agreed, arrangements have been made to replace the bedroom carpet. Tell them the date you have arranged with the carpet fitters and ask them to confirm that they will facilitate access (or alternatively that they are happy for you to attend to let the fitters in on that date) and ask them to ensure that the room is clear so that the fitters can work.

    Confirm that you are not planning to replace the other carpets at this time, and that this was not something which was agreed, and that the agreed rent reflects the style and condition of the poproperty which they viewed before signing the tenancy agreement. Remind them that if they do not pay their rent they will be in breach of the tenancy agreement.

    Make sure that you keep a copy of the letter. I personally would suggest that, even if you send your reply be e-mail to start with, that you also send a hard copy by post, and get proof of posting.

    It seems as though these tenants have an unrealistic idea of how renting works.

    They can't not pay rent just because they don't like something. If they didn't like it they should not have decided to live there.
  • Stop communicating by text and put everything in writing (ideally in proper English). Join a Landlords Association; I predict you may need their expertise.
    They are an EYESORES!!!!
