    Legally, they'd have to make an adjustment for you so, yes I expect it already exists and if not, they must start one!

    Lidl Management staff cars are on it usually but it is normal to ask a retailer with a car park to add a disabled VRN (or their carer's VRN, like you) to that exempt list. They can take that 'reasonable adjustment' to ensure you are not harassed illegally like this again.

    So what, really, she can take her time if she wants.

    She's disabled and cannot be bound by the arbitrary time limit. Get angry and assertive about this and stop thinking you have to make excuses.

    Just called my mother, she is going to send me a copy of her blue badge and a her bank statement saying she shopped at lidls. Here is what i have so far, how does this sound?

    Dear Danielle Shankland,

    The ten minute period referred to is not just for non-customers or taxi drivers, it applies to all people, furthermore it applies for both entering and exiting eg. 20 mins and is not arbitrary. Your contractor already has the keepers details and registration from DVLA obtained without valid warrant or my permission. Complaints will be put to DVLA on the keepers' behalf regarding Athena ANPR Ltd and your involvement with them regarding this potential breach in the Data Protection Act.

    Please be advised that you are liable for the actions of your contractors and agents and I demand you cancel these CPNs under the Equality Act of 2010 as you must take reasonable adjustments. Both Keepers have disabilities that are protected characteristics in accordance with the Equality Act 2010 and require Lidl as the principle to inform the agent, Athena, to cancel the parking invoices and add the details of both cars to your store’s ‘white-list’ so they never have to suffer this stressful situation again.

    A white list is only registered to the vehicle and not the occupants
    From the Plain Language Commission:

    I think this letter and its tone will just about scupper any good will that you may have had with Lidl. Their letter is, on the face of it, an offer to help. You are chucking it back in their face.

    You will fail an IPC/IAS appeal - most people with even better cases than you, get their appeal turned down so if you can't get Lidl to lean on the PPC, be prepared for court if they decide to take it further.

    I suggest you try to give them the information they ask and hope you can take them at face value.

    But it is your call.

    I would suggest not using words like 'I demand' and just write something along the lines already suggested above, with a seven day time for them to respond.

  • You say their letter is an offer to help but they are stating that if i send them the information they will appeal on my behalf. Should I give them permission to send my details on to their Car Park Management company to appeal, and do they mean athena? because it says above to not let them appeal on my behalf. Should i state that I do not wish to appeal and just push for the CPN to be cancelled?
