Request for popla refused despite quoting legislation, what to do now?

    Do I need to contact Gladstones and or the courts to tell them I wish to proceed to an oral hearing?

    The form sent to me by the courts makes it difficult to state this, as well as the fact that Gladstones have refused mediation which is what the form is essentially all about. Surely the courts would take a dim view of this though? What is the point in offering it to me if Gladstones have already said no? I think I stand a good chance in all of this, but I don't want to !!!! it all up otherwise it won't.

    You need to tell the court. You can 'phone them and ask them how to do this if you are unsure.
    Hopefully one of the more experienced regulars will advise on this soonly.
    I don't know if you should or even need to tell gladrags, but you definitely need to tell the court.

    Also mention that you asked to appeal via PoPLA but were refused and lied to at the time. Let the judge know that the PPC told you that the POFA only allows you 28 days to make an independent appeal but you have found out that it does not, and also that the Alternative Dispute Regulations 2015 stipulate that the UK Government requires that independent appeals must be allowed for not less than one year.

    To save both parties money, and the court's time, say that you are willing to use PoPLA.

  • Due to a monumental faux pas on my part I am unable to phone the court today. Am I right in thinking they will only speak to the registered keeper anyway? If so my husband will have to contact them tomorrow.
    Curiously enough all Minster Baywatch signage had been removed and it looks as though it's been handed over to Branby Wilson Parking Solutions(I think that's the name)
    Does anyone know whether it's worth complaining to the SRA about Gladstone's or should I just leave it?

I will have to ask my OH to phone the courts tomorrow to let them know we wish to proceed to an oral hearing and that Gladstones have already said no to mediation (which the court appears to know nothing about). Not that I wanted to mediate anyway.

    Coupon Mad has helped me a lot with this but i'm guessing she's busy with other things at the moment. If anyone else can advise as to what I should do I'd be really grateful.

    "Why are Gin and Milk planning on phoning the court, when all they need to do is put two words* into Google or the forum search?! That's what the search is for.

    Or they could out the same two words* into pepipoo search function! This is the same issue that happens every single time with Gladstones paperwork...it's on every thread - has been done to death.

    Gan has written umpteen times on pepipoo what to say about this standard trick by Gladstones. On both forums, dozens of threads tell you what to say in response, when their actual DQ arrives from the court, as does a Google search which finds the Parking Prankster talking about the same thing.
