Hi MumofTwins, i haven't posted much because I've really no knowledge of what to do in your situation at all, and I didn't want to just guess and get it wrong, but I've been reading, and I just wanted to say I think you're amazing. A lot of people would have completely fallen apart - you are so strong and have so much fight and spirit in you.

Sorry, I just wanted to say that. :o

Been to meeting with Shelter who have all the details and now have to wait until council give a final negative decision before they can help anymore.

She said that I will have 21 days in which to inform council that I am going to appeal and they then have to arrange appeal within 56 days. However.................she said that whenever Shelter has represented someone at an appeal with my particular council they have NEVER won:eek:    . Apparently this council is in the only one in Herts that has an oral review (the others all deal with appeals by letter) and that there are 5 councillors who form the appeals commitee, the Head of Housing and my HLO and anyone else they want there then me and my representative. It is set out like a court room (HofH used to be a Policewoman).

So, I politely suggested that Shelter give me all the back up needed with how to write letters for submission, who to contact, how to query the 'prosecution' and how to defend myself and that I will deal with it as if I have done it all myself - as I get the feeling that my council do NOT like Shelter. I can take someone with me to speak on my behalf or just for support so guess who I'm asking when he comes back from rainy, cloudy Majorca.

The Shelter woman also thinks I would be able to put across my case well as I am not a 'run of the mill' type of housing applicant, and that the panel are very much upper middle class comfortably off ladies and gents who hopefully will see that I am someone who really does need help and has just fallen foul of extremely difficult times.

She also made the point that a lot of you on here have made and that is: That the house has always been up for sale and that eventually I would have had to leave anyway. So she asked me to get the LL to do a letter confirming that the house has been on the market for some time and that I would have been asked to leave. So that is another point in my defence.

This is sounding more and more like a criminal court case now!

She also said that we will be able to get the council to ask more relevant questions of my Dr with regard to my depression and how it is affecting me as she knows that the council form is not very specific in what is needed to be known. Shelter also have their own form which the Dr will be asked to complete and it is done for each client to suit what their own particular problems are.

Phew! Can't think of much else, but if I do will post when I remember xx

dont worry about an oral review as this will allow you to answer any questions directly. They can also see what type of person you are, shouldn't make a diffeence but it can do unfortunately.

Don't give up hope yet as you have not had a negative decision yet.

  • I cannot believe they have let it get this far. Can you refuse to leave the property you are in? So that your LL will have to put up a fight to evict you? I know it's been through the courts etc, but surely this will show the council that you are only leaving bacause he is making you due to him wanting to sell his house?

Thanks Teeni, I am glad that I have a chance to 'present' myself before the appeals committee and that I can take I-T with me as I admit to having more faith in I-T's verbal deliverance than most other people that I have met throughout all this!

This is where I come unstuck Nicola as I just don't know what to do for the best - it is also where I fall apart as I am so confused by the whole thing. Over the last few days I have had stinking headaches - must be because of the confusion of all this mess.

Just had a though MOT - have you made arrangements to get your post redirected somewhere else? you don't want to be having to turn up at the property every day asking if there's any post for you.

Could you use I-Ts address for that or, perhaps, another friends?

Or take out a post office box?

Hi soappie, I thought that I would arrange for Royal Mail to do one of those 'keep safe' thingies where they keep the post for you at the sorting office. I could have it redirected to I-T's and he has suggested it, but as he lives 7 miles away it would easier to nip into the sorting office. Going to do that tomorrow when my money comes in. Thank you for thinking of that though xx

  • My thoughts are with you and if I only lived closer and in a bigger home I would offer you a place to stay. Sadly I'm in the East Midlands in a two bed for 3 (soon to be 4) people :(

It angers me that people are treated so terribly, even those who have children to worry about.

    I've been Money Tipped!
hi mot did you find out if your housing benefit was right as the law says you must have a set amount to live on if the housing benefit did not leave you enough money to live on after paying the rent they are at fault and then the councill would have to take you on as homless as there would be no case to answer if the reason why you fell behind with your rent was because they had not given you the right money to live on you can see what the law says you need to live on in your housing benefit letter what they sent you when you first claimed its usally on the back of the letter hope it gose your way
i cant slow down i wont be waiting for you i cant stop now because im dancing
