    Ok, I've read back. Have you spoken with your MP lately MOT? I think this is totally disgusting, do make sure the MP is up to date, do go through the appeal and for goodness sake don't give up.

    I am so sorry that you have had this news.

    I expect it is unusual for a letter to be hand delivered, and this act may well reflect the 'heat' that is on them to get your case off their desks. It would also follow that they would then be able to say to write to: CEO/MP/Gordon Brown:

    1. made a decision first thing on 25/10.
    2. decision immediately communicated to MOT by email at (time).
    3. the Housing officer called in person, with a hard copy of the decision later the same morning.
    4. A meeting with MOT to discuss any further issues was held on 26/10 with the Senior HO.

    5. At the meeting on the 26/10 MOT was unable to furnish further evidence that mitigated the rent arrears. The conclusion of this meeting was to uphold the decision of the 25/10.


    They will have then succeeded in getting responding to all the great and good on the case. This is likely to be a much higher priority than really resolving your problem, and despite their 'procedures' they will see you as a pain and have no empathy or personal goodwill towards you.
    • Consider the advice from G Force to meet on a day of your choosing.
    • Do get Shelter to review your file.
    • Do present strengthened evidence concerning the causes that are not rent arrears related/further support you have sought.
    • If they are going to overturn their decision (having made it in the glare of CEO/MP/Prime ministers office) they are going to need to feel it is not a career damaging/PR blooper on their part.
    • So if you want them to overturn it at this stage you have got to make it a win/win situation
    • You goal is for them to say "at the meeting MOT presented material evidence not previously available to us. We considered this and that had it been available in the original decsion making forum we would not have concluded that MOT made herself intentionally homeless."
    At the highest levels of public complaints,
    you do need to take account of 'loss of face'

    Fantastic advice from spirit there. Remember my offer of help? Well, do call on me if you need any support for meetings and things while Italian tony is away. I'm just up the road and will happily come and stand next to you to as either a voice or just for moral support. As I'm off work at the moment I can manage just about anytime.

    MOT what have Shelter said about your appointment tomorrow? Do they think you should go?

    Spirit - you have been reading my mind.

    mot - you need some legal/charitable representation/support at any meeting now proposed by the HLO - even if this means postponing until you have spoken with shelter or CAB.

    IF you do postpone your 'meeting' make sure that you inform the HLO that you are doing so because you are not happy with the decision and wish to seek professional advice and someone acting with you/on your behalf to also be present at any such meeting.

    Make sure that you make this request in writing - email at least.

    Spoken to Shelter twice today, and I will be going to the meeting tomorrow and will re-iterate everything I have already told them and go into more detail about my past and how that has affected the way in which I am now.

    Is someone from SHELTER accompanying you to the meeting, or are they, and you, happy that you can and should attend on your own?

  • I was proposing to go to the meeting with MOT tomorrow but your advice that she should delay it until she can attend with someone from Shelter or other legal representative is very sensible. MOT is determined to go tomorrow but will it be possible to say to them that MOT has attended to start her appeal but would like the opportunity for another meeting after she has met with Shelter when she can then attend with a professional adviser? I'm sure MOT and I can give them chapter and verse about her health and financial problems and the behaviour of her landlord but I worry that if this has to be a one meeting only situation we could blow her chances of a reversal of their decision.
