I only started reading last night and am only half way thru the thread....can someone briefly let me know what has happened to MoT and the twins today? I know it can't be good, the poor love xxx0

i know this might be a silly question,:o but does this mean that mot can never have a council house
or is she still able to go on the list and work her way up?( i know that doesn't help immediate situation)
because it doesn't make sense to me if she can't as she was previously in private renting not council propertyso hasn't flounced any tennacy agreements as such.

not silly at all she can still have an allocation if she is lucky off the normal register but no teligible for help as homeless, problem is it can take for ever to get a house that way.

MoT's appeal decision was " unanimous no".
Her stay in her flat is due to finish on Monday 21st January. That is the due date for her to leave the temporary accomodation. She has already been given the correct notice for her current tenancy (emergency housing)
The Council do not have to house her at this time, UNLESS there is to be a County Court appeal on a point of law and the Council are ordered to by the County Court (which is up to the Court).
Her medical evidence of psychiatric & psychological reports was not taken into account by the appeal panel.
MoT probably won't be posting tonight, as she is taking a well-earned rest.0 -
Omg, I can't belive it. It just makes me wonder what people have to do to get a council house. It's great to think that any of us find ourselves in difficulty the council will do everything possible to classify us as intentionally homeless, probably to massage the waiting list.:mad: :mad: :mad: :mad:

Hi, I'm a long time lurker and have been following this thread with increasing horror...it's simply unbelievable that in this day and age a family is effectively being abandoned by the authorities. What's the point of paying our taxes if good people like MoT can't benefit from it?! Everyone deserves a warm, safe home, and no-one more than this wonderful mother who is trying her best to keep her children safe and happy. I'm so sorry that this is happening ((((((MoT)))))), it's awful. My thoughts and support is with you. I wish there was more I could do. Thanks for setting me right on the tennacy thing earlier, I was not sure.
The only think I can think of is that MoT books herself into a B&B or 1 bed flat and then goes to the council housing department and do it that way. Check to see if they have the points they allow on their website, then she can see if she will get enough points. here they house you if you have 120.
In regard to the people who have asked - if you look on your local council websites it will tell you who has priority, here it is people who have just come out of prison, those who are vunerable (mentally ill for example) and those with 'addictions'. We are going to be in the same position as MoT in a couple of weeks time (have to say pretty scared now) and the difference between 'housed' and 'homeless' is that enough points will get you housed, where not have enough points and being evicted makes you 'homeless' and gets you into temporary accomodation until something comes up on the council list. Apparently. In our case the council have not even given us the correct number of points (as what they say they should on the wesbite), I have called to ask if my son has been given his 'medical points' (he has been referred for ADHD/AS/ASD and waiting to see paediatrician so comes under mental health) but they refuse to tell me on the phone and I have to 'wait for a letter'. If we don't have enough points and the court order comes through for us to get out then they will pass us over to the homeless department and the housing can then 'wash their hands' of us and the homeless department will then deal with us. When I asked Shelter about this they told me that 'the council do not always do what the law tells them they should'. And to fight this you have to get a solicitor to do it for you. That is just to get your entitlement and all the stalling means it pushes you onto the 'homeless' side rather than the side to be housed. I have had to send them all my bank statements, hubbies wage slips, Child benefit and tax credit letters - they want to know everything. 2 weeks until we get taken to court for an eviction date and they still can't give us a straight answer as to whether we qualify for housing and I went to them 2 months ago. I sent all my paperwork 6 weeks ago but (and now I think this very suspicious) the paperwork arrived a day after the doctor arrived to allocate 'medical' points (which MOT should also get due to her depression - it comes under mental health), the longer they leave us then they can pass us over as homeless and not have to deal with us.
MoT has more strength than I think I would have had, but if you read this MoT please see how many points you have see if you can get some dire accomodation that might mean you end up with enough points to get somewhere. You'll get points for the kids, local connections, lack of rooms, depression, low income, etc... That might help somewhat. What's daft is that she probably does qualify anyway but has to go about it a different way than she is now and will qualify. the whole system is nuts in my opinion!!
Oh another though, what about a caravan you can park somewhere in someones garden/caravan park (I am not sure, how much do they cost?), it sounds a bit grim but that gives more points in this area to be in a caravan (40) and that would be enough, with the other bits such as kids, local connections, lack of facilities, to get you housed.
Sorry, it's the best I can offer in the way of suggestions, but I hope that by explaining this you see how it works and how sly the council housing departments are. it is a fight to get it even if entitled and they lie no end, even suggesting things to me to get my chucked of the list by making ourselves intentionally homeless. If you don't have your wits about you then they'll screw you over.0 -
MoT once the dust is settled I'd be giving the paper another shout.
It's an almost certain front page splash and won't hurt to give the council another shot of negative publicity.
