Good luck for today MOT, remeber that as you have children the courts should be more supportive. I hope it all goes well, and remember you can only go so far down before you start to go up.

Will be thinking of you x:A
Thanks sasp, appeal is Thursday at 9.30am, so I-T, SF and I are trying to make sense of all this so that I-T can put a good case forward (and that it makes sense for SF to take notes!!)

  • Hey there hon! Good morning!
Sorry to hear about the restless night- perfectly understandable, though. I know it's pretty daunting, now it's so close- but don't forget to make some 'me' time for yourself! When we were waiting to hear the outcome of our homelessness case, there'd be times I would completely switch off and it'd be almost as if it wasn't happening. I got really worried for a while, thinking that the whole depression was going to get me again- or that I was being stupid and refusing to face up to reality. A friend pointed out to me that if I'd ignored the whole situation all the time- that would be 'head in the sand' - but mentally taking time out from it all was my way of taking a respite and giving myself a chance to recover my strength. I'm the sort of person who has to step back from it all sometimes, because I'd explode with all the worries and busy-ness in my head otherwise- and be no good to my kids at all.
I guess all that waffle really just means- step back, take a breather from time to time (hours, minutes, or even seconds), and feel proud of your incredible strength.
After that, I think I'll go make a cuppa. Fancy one, MOT? I'll even give you the pretty mug!

Hi PF, thanks for the offer of a cuppa unfortunately I had taken myself off to bed again for a nap! Only woke for the bathroom and could've gone off again but solicitor rang so I'm up now.

Solicitor has sent representations through by email for I-T and I to peruse - have had a brief read and they seem very thorough.

MOT/IT: good luck with the appeal on thursday - I'll be eagerly reading to see what happens. Has the solicitor said how long it may go on for? i mean.. day/days/weeks (hope not!)?

    Hi Keth,

We will be given a decision on Thursday morning - the appeal starts with the evidence being put forward from both us and the Council, then witnesses (if any) are called and questioned. We all leave the room apart from the panel who then deliberate as to my fate - there are 5 of them and it has to be a majority vote, so a minimum of '3 for and 2 against' the decision. We are then called back in to hear the decision. I am then given the decision in writing within 7-14days.

Wishing you the MOT, if there is any justice in this world, you will win that appeal.

    I'll be thinking of you.

  • Hi MOT

I have been reading your thread all the way through but I haven't posted before.

I just want to say good luck for Thursday - I have everything crossed for you!

So fingers crossed all morning. Do you have the right to appeal the appeal? Can DBC appeal the appeal or is the decision binding on both of you?
