Faulty mobile with Vodafone- Any ideas?
I have snet my phone off for repair 3 times in the last month. The last time a note was attached by the staff at local vodafone store, so that a supervisor could take a look. Every time I get it back, they say it is a software fault, but the problem is never fixed. The girl that I spoke to said that if I had any more problems with it that i would be entitled to exchange it for a new phone (same model). Well the problems are back again, with an added one!
I phoned Vodafone only to be told that I was never going to get a new phone off them and that I had to send it off AGAIN:mad:
I am seriously fed up, it takes over a wek to "fix it" leaving me with a cruddy old phone to use. Where do I stand with this-I even renewed my contract the other month and am now tied with them for 12 months (kept my phone)
I phoned Vodafone only to be told that I was never going to get a new phone off them and that I had to send it off AGAIN:mad:

the first thing that comes to mind is Fit for the purpose ,all this is covered in the sales of goods act,

networks seem to flaunt the sales of goods act very often ,i would ring the consumer direct too ,if you have a case they will help youthere or their,one day i might us the right one ,until then tuff0 -

Unless its a phone with a 2 year warranty then you dont have a case
Some people on this site just go about quoting the sale of goods act for everything but its a phone
Phones are highly used and tbh I doubt you could prove that all phones are required to last more than a year especially given their high usage and durability0 -

Its out of its 12 month warranty by 9 days. The probelms started over a month before time was up, and was guarantee problem would be sorted.0 -

Update: just spoken to Consumer Direct, told me about Supply of Goods & Services Act. Doesn't matter about warranty.
Just spoke to Aiden(Vodafone) who had to keep going off to his supervisor. Supervisor said that warranty doesn't matter becasue I got a new contract with them-whatever! I went on for a bit and supervisor just said that its down to manufactureer to sort it out and that I have to go to local store to get them to contact manufacturer. So i hung up, will go to store tomoz, see what they have to say about the matter.0 -
The warranty is offered by the manufacturer, not Vodafone. Although Vodafone try and help with manufacturer warranty claims (offer repairs by post or via store), ultimately the policies surrounding warranty are set by the manufacturer. Its not the case that a replacement phone should be issued, and in most cases manufacturers will always try and repair the fault but not replace the equipment.
As you're outside of the 12 month manufacturers warranty, technically you're no longer covered by warranty. If you'd like to get in touch by email, I'd be happy to try and help resolve things for you. Unfortunately, I wont be able to authorise a replacement phone to be issued, but I can arrange for another repair to be attempted.

Thanks Faza. but Consumer Direct have already told me that I am entitled to a new phone- thats the point. Vodafone retail said this, now vodafone (over the phone) say no, let retail deal with it. If nothing has been done in the next couple of days I have been advised to write a letter and ask for action within 14 days. If nothing is done Consumer Direct say they will intervene.0 -

Hi Justpaper, its a K800i, best phone I ever had (well except from the faults) It overheats very quickly and if its charging & someone phones I can't put it to my ear cos its so hot. It makes the occasional beeping noise-like someone is pressing their keypad, except they aren't, and it cuts me off halfway thrugh calls. Every time its been sent off for those problems they say its a "software fault" and now I have the annoying problem that evertime I try to hang up it goes to speaker phone first.:mad:0
