Apcoa parking notice

Apologies -have just noticed Sticky for newbies -will read first -so sorry


Please can someone advise us. We have received this notice and are not sure what to do
We parked in the drop off /collect area, after paying, but our friend couldnt find us
after arriving in Luton. We didn't notice any signs and didn't have a clue where we where going. He got lost, so we drove and found him and he jumped in the car -all of 10 seconds.

Also I noticed this 14day period for receiving the notice. The incident happened on 02/09, the date of notice was 16/09 and we received it on 17/9.. That's 15 days, is that correct?
I have seen the appeals to POPLA which we will do, however do not have a clue on what to write to APCOA, well nothing polite anyway. Can so,some advise us please?

    Take notice of coupon-mad and appeal.

    These are not fines ... they are simple invoices from companies who like to scam people out of money

    We'd all eat our hats because:

    - we always beat APCOA at POPLA stage, as long as you use the right words (nothing about the driver)

    - APCOA do not try court!

    How many times do we need to say 'APCOA are a cinch to beat and we always win at appeal?' No need to worry.

    Re: PCN No. ....................

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers before they park.

    Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. I believe the driver may well be eligible for cancellation and you have omitted clear information about the process for complaints including a geographical address of the landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    I have received an unsuccessful appeal letter from Apcoa following my initial appeal. The letter also contains a "written authorisation of the Landowner" and a picture of a sign saying "Restricted ZONE, No stopping at any time to drop off and pick up. CCTV and number plate recognition in operation. Warning enforcement charge of £80. This is a private road".

    There is also a badly drawn map, apparently stating where the signs are placed.

    Is this a standard response?

    You haven't told us the important bit. Did you get a PoPLA code? If so, use it. If not, complain to the BPA and DVLA.
    Also, whereabouts in Luton did this happen. Was it at the airport? This is very important as if it was, you will have an additional appeal point.

    Please read the most recent successful appeals from the POPLA Decisions thread and cherry pick all the bits that apply.

    This will include at least, not the landowner, no standing to issue charges, inadequate signage, non POFA 2012 compliant NTK, and not relevant land if this happened at the airport, plus any other relevant points you can find.
