Got keys.. but rubbish left =/

Hi
I would like some advice, basically after we got the keys we found items left in cellar tbh looks like been there for a while...we contacted the lawyer and estate agent and told them about this as in the contract it was said these things will be removed.....
it has been 3 weeks now and aint heard any thing ......we are going to send a letter to the previous owner and their lawyer saying that if these stuff are not removed in 3 working days then we will dispose of them and also charge them for it and claim for damages as they are breaching contract i think....
the reason we are !!!!ed of is because it is slowing us down with works which are needed to be done and we are going to have to pay for a skip and 2 men to carry the stuff from cellar..we could do it our selfs but the items their are mouldy and basically not worth touching...
i would like advice on what we can do ........
do we have a leg to stand on .......
any advice and similar experences is welcome

Purchase in Scotland (where there are specifics in the standard clauses) or E&W ???0

You can incur solicitors fees for them writing letters/taking further action.
Or you can get rid of the stuff.
Have you involved the estate agent? He can probably just speak to them on the phone and establish whether the goods are forgotten, or not wanted. And hopefully urge them to sort it without involving solicitors0 -
Just get a skip and do it yourself. It'll be weeks before its resolved and will cost you a lot more than the price of a skip.Eat vegetables and fear no creditors, rather than eat duck and hide.0

Well, yes, technically they are in breach of contract, and I believe the procedure would be to contact them to give them a reasonable opportunity to come and collect their possessions, after which they will be disposed of, and (possibly) billed for storage and then disposal of said items.
However, as far as you are concerned:
- you can't claim for damages, as you have suffered no damage by having this stuff in your cellar for a few weeks.
- 3 weeks, then notice to remove within 3 working days is hardly offering a reasonable opportunity to remove their stuff.
- trying to claim for a skip and a couple of blokes to cart the stuff out the front door because you can't be @rsed to put on a pair of gloves and do it yourself the night before bin day is hardly very reasonable either - I'd give you a fairly "robust" reply if you tried to pull that stunt on me.
So you've got half a case, should you have the time, energy and money to pursue it via your solicitor, their solicitor and the small claims court. Alternatively, if you're having work done anyway, write one more letter then dump the junk with the inevitable mess that whatever work you're having done will create and get on with your life.0 -
ok fair enough but it is priniciple ....
we have tried to contact them over ten times in 3 weeks but no reply .....
i would not use a solicitor i am sure i can go to small claims court and deal with it myself ....
if you just brought a house full of rubbish in cellar an you had been told it will be removed and it has not been wouldnt you feel !!!!ed off.....0 -
I would be tempted to load up my car & deliver it to their new house and deposit on the driveway. In the dead of night of course.....:rotfl:0

This.
Our house, the vendor left rubbish/ carp in all the kitchen cupboards, the under stairs cupboard, garage, shed. Two skips worth.
The also turned off the gas and took two gas fires, leaving the pipes uncapped. Que an emergency plumber.
Took light fittings leaving bare wires, not made safe.
Was awarded about half the costs of sorting this all out. Incredibly annoying but just draw a line and move on0 -
But any claim in Scotland has a £300 min value, which hiring rubbish removal people won't cost0
